专利申请方面的专业人士,或者有最近申请专利经验的专利拥有人,如果感兴趣,本人想付酬请您准备一下申请材料及咨询。谢谢!
这是申请知识产权专利的政府网站
http://www.cipo.ic.gc.ca/eic/site/cipointernet-internetopic.nsf/eng/h_wr00001.html
Thanks everyone for the information. It is intended to go through a registered patent agent. But even so there will be lots of paper work to do. I wish to get help on this (self-prepared paper work) from someone with experience.
Since people are quite helpful here, I want to share with you what I think.
Just went through the whole process. If you just want to file a US Provisional patent, it is not worth spending thousands of $ to hire an agent. They ask you to write detailed description. The fact is that with those deatiled writing, you can file it yourself with $110 within one hour.
You may argue that professional (patent agent) filing is stronger. That is not true. Provisional patent filing in general is of limited value, no matter who does it. However, with $100 of cost, a US Provisional will at least provide you evidence that you had the idea at the time of filing. And if you can legitimately claim "Patent Pending" status.
If you apply through a registered patent agent, the agent can take care all the requisit paper work. What you will need to do is to sign a form that authorizes the agent to act on your behalf, to educate the agent what your invention is (face to face meeting or in writing), and to pay service fee in addition to government fee.
If you have decided to apply through a patent agent, you should get the agent involved as early as possible in the application process. As one has pointed out, Canada has a first to file system. The defects in an application as originally filed may not be cured by amendments even if an experienced agent is involved later.
Don't know where you want to apply, US or Canada, or both. If you plan to apply in Canada, you should get a Canadian patent agent who is normally also authorized to practice before the US patent office for filing a US application for Canadian residents. A US patent agent cannot help you for filing a Canadian application if you are not residing in US.
You may tell us where you are now in your application and how much you plan to spend. Those information are important in terms of offering advices on how you should proceed.
Hope this helps.
