A friend of mine was riding on the bike at night and was hit from behind by a car. He was injured and brought to the hospital by 911 service. Also he had some loss for his stuff: his laptop in the backpack was totally trashed and the bike was of course was destroyed (useless) and ipod, pants, etc.
Should this be compensated by that guy or his insurance? My friend called this guy and wanted to settle this with him, but this guy is so rude and claims that my friend is 50% wrong by not wearing the helmet and rode the bike in the wrong lane. I totally disagree. Rearending and hitting a cyclelist is simply wrong no matter what.
