OTTAWA — The city’s odds of successfully appealing a ruling letting its composting contractor accept diapers and plastic bags at a south Ottawa plant are poor, according to the city government’s top lawyer. Rick O’Connor, the city solicitor, told city council’s environment Tuesday morning that a decision by the Environmental Review Tribunal, a provincial agency that last week overturned a Ministry of the Environment rule forbidding Orgaworld to accept those items, would have to be “patently unreasonable” for a judge to overturn it. That’s a high standard, O’Connor said: the ruling would have to be so bad, so contrary to the law, that a court just couldn’t let it stand. And much as the city might not like the decision, it’s not that appalling from a legal perspective.
