Illegal search leads to child porn acquittal

An Ottawa man charged with possessing over seven thousand images of child pornography has been found not guilty, after a judge ruled the Ottawa Police conducted an illegal search.
Police were searching the apartment of Justin Dufaure for an AK-47 and a handgun, based on a tip from a confidential informant.
It was during that search that a police officer found a thumb drive storing images of child pornography.
Ontario Court Justice Catherine Kehoe found Detective Paul MacKillop violated Dufaure's Charter rights when he decided to search the digital storage device in Dufaure's bedroom.
MacKillop testified he was searching for pictures of the gun to establish evidence of ownership, when he came across the porn.
He said he believed it was a lawful search.
No guns were ever found.
This is the second time in the last two weeks that serious criminal charges have been dismissed because of illegal searches by police.
Last month, an Ottawa man charged with possession of a sawed-off shotgun was acquitted when a judge found police illegally searched his car.
