A fitness company that lost a trademark dispute earlier this month opened its new Kanata facility Friday under a new name.
The Athletic Club — which operates 11 other clubs in Ontario, including facilities in Orléans and the Ottawa Train Yards — was barred by Ontario’s Divisional Court from using its trademark following a successful challenge from the Ottawa Athletic Club (OAC).
On Monday, the court issued an injunction preventing the company from opening a facility using the Athletic Club trademark. That forced a delay in the scheduled July 21 opening of the Kanata club.
The company advised anxious customers on its Facebook page Thursday that the Kanata location would open for business Friday at 7 a.m. under Ariston Fitness, its new name and brand.
It said on Facebook that the Kanata club would initially offer limited services, “as our primary objective was to open the facility as soon as possible.
“We appreciate your patience during this challenging time,” the Facebook message continued. “We know this has been an inconvenience for everyone, and we want you to know that serving our members and the Kanata community is, and always will be, our first priority.”
The posting said final resolution of the trademark issue was “still ongoing,” but added that the matter would have no impact on members or the club’s day-to-day operations.
The Divisional Court agreed with OAC arguments that the Athletic Club’s name was too generic and descriptive and was insufficiently distinctive to qualify for trademark protection under law.
