Calypso Water Park pleaded not guilty Wednesday to 20 alleged safety violations under Technical Standards and Safety Act.
The charges stem from an investigation following accidents on the park’s Steamer and Bobsleigh slides that injured customers in 2011 and 2012. The trial got underway Wednesday in Ottawa and is expected to last three weeks.
Two of the incidents on the Bobsleigh ride happened on the same day in June 19, 2012, when two men were sent to hospital after one bobsleigh-style inflatable tube crashed into another on the slide. Allegations include that staff prematurely sent park visitors down on a tube while another tube was caught in a slide.
Calypso is also accused of not shutting down the Steamer after repeated incidents that constituted an immediate hazard to a user’s safety and for failing to report incidents where people were hurt on the slide in 2011.
The TSSA also laid a charge in relation to an alleged lack of supervision on a children’s water playground known as the Pirate’s Aquaplay.
If convicted on all counts, Calypso could face a fine of as much as $20 million, although such heavy maximum fines are usually reserved for repeat offenders in the worst cases.
The water park, located near Limoges about 40 minutes east of Ottawa, is also facing several civil lawsuits alleging millions of dollars in damages for incidents that resulted in injuries at the park. At least two of the lawsuits relate to the TSSA allegations.
