  据香港文汇报报道,违法“占中”持续瘫痪香港多个主要地区。对此香港立法会内务委员会昨日(10月10日)以35票赞成、25票反对的结果,通过了香港经济民生联盟(经民联)议员林健锋提出的动议:引用《权力及特权条例》(下称“特权法”)以调查非法集结的背后策划、资金来源以及政府的处理手法等。多名议员认为,“占中”团体藉瘫痪交通威胁特区政府与中央政府让步,其组织能力及动员能力更超乎想像,因此立法会有责任成立专责委员会调查真相。


  林健锋10日在接受记者访问时表示,已经通过呈请书和动议引用《立法会(权力及特权)条例》,全面调查“占中”背后的组织策划、资金来源,以及其所引起的公共秩序和安全等问题。林健锋指出,以往反对滥用《立法会(权力及特权)条例》,但“占中”却事关重大,立法会除了要监察政府外,也有责任关注香港的公共事务、经济发展,以及市民的生活,引用特权法可以传召不同人士。

  全国人大常委范徐丽泰也认为,现在是别有用心的人利用大家都爱护的年轻人走出来,而他们自己就躲在幕后,给予支援、物资。她指那些不想香港人好的人现在就“阴阴嘴笑罗”,市民却被绑上战车。范徐丽泰说,学联要求特首梁振英下台,但这不是特区政府所能决定,因为特首是由中央任命,而若每次有群众活动、有人上街,特首就要下台的话,“社会安宁去了哪里呢?”她表示,特区政府暂时不与学联对话,但并不是永不对话,相信仍有转机,不过不可能两三日内解决,若学联不是经常转变立场,会有助巩固对话基础。

  民主建港协进联盟(民建联)主席谭耀宗表示,“占中”非法集会期间,有示威者大规模违法占据道路,严重影响市民的日常生活和生计,对香港整体利益造成严重损害,经济损失难以估计,令香港的国际声誉严重受损,并导致社会严重分化,所以要对“占中”进行全面调查,让社会和市民全面了解。

  最后立法会以35票赞成、25票反对通过动议,引用“特权法”调查非法集结的背后策划。林健锋强调,“占中”发生十多日,港九各地的违法集会阻塞多条道路,令社会进入不稳及撕裂状态,并引发连串社会冲突,集会背后的组织能力和动员能力更是超乎想像,要求立法会成立专责委员会,从多方面调查事件起因,全面检视是否有外部势力煽动组织以及背后资金来源,同时审视事件对香港的影响,盼报告让香港尽快恢复原有秩序。

  新民党主席叶刘淑仪说,好多市民是自发性和平集会,但集会是非法的,加上近日不少相片显示,大批示威者偷走政府公物,包括铁马及围栏作为路障,这些原先是供烟花活动维持秩序的,说明这是非法及有组织活动,值得立法会调查。

  经民联议员梁美芬强调“占中”集会是非法活动,不能以和平集会作为藉口四处捣乱,“占中”被质疑由英美势力策划及“台独”势力协助,鼓励青年及妇女走到政治前线,导致香港出现前所未有的撕裂,“今天市民的容忍程度已经达到顶点,市民要求立法会调查是次有组织的大型非法集结。”

  商界议员廖长江直言,“特权法”不单是监察立法会,并须调查具重大影响事项的真相,而自“占中”爆发后的非法霸占,令香港出现了罕见的非法集结,严重影响700万人的正常生活,这是不争的事实,认为立法会引用“特权法”调查是适当做法。

  议案最快可在本月29日的大会讨论。

这不奇怪,大部分议员都是北京选择的,当然会按北京的意图要调查占中背后的势力。为什么不调查占中的原因?为什么不解决占中的原因然后将来避免占中的再发生,而是要调查背后势力然后把背后势力关起来,占中就将来不会发生,香港就和谐了?一整套大陆政治的思维。

Planning an Outdoor Special Event in Ottawa
The City of Ottawa enacted the Special Events on Public and Private Property By-law No. 2013-232 on July 17, 2013.

A "special event" under By-law No. 2013-232 means a fair or festival, or a social, recreational, educational, community or similar event that is occurring outdoors on any property that is not a city street / sidewalk and having an expected attendance of at least 500 persons at any one time during the event, and includes a Beach Event.

If your event has less than 500 people in attendance, please note that Event Central can still assist you with the coordination of City Services for your event.

Events taking place on a city street / sidewalk are subject to the conditions under By-law No. 2001-260. A “special event” under this By-law includes a demonstration, parade, sports event, festival, carnival, street dance, residential block party, sidewalk sale, outdoor mass and other like events;

Based on the size and complexity of your event sufficient notice is required to process your application. This ensures that all facets of your event are able to be addressed in order to deliver a safe and successful event.

When do you need to apply?
If your event has an expected attendance of at least 500 persons at any one time or is taking place on a city street/sidewalk

If you are planning a special event in Ottawa, you will need to complete and submit a special event application to the Event Central office prior to your event.

Application deadlines:

  1. 30 days in advance of the special event, if the special event,
    1. includes pyrotechnics or fireworks,
    2. includes the preparation, storage, handling, serving or sale of food or beverages,
    3. includes one or more vendors of any type,
    4. includes or uses one or more vehicles,
    5. uses City property, or
    6. includes open air fires
  2. 60 days in advance of the special event, if the special event,
    1. uses property owned or leased by the Provincial or Federal government,
    2. requires a noise exemption pursuant to the City's Noise By-law,
    3. uses or includes aircraft, watercraft, or helicopters, or,
    4. includes or uses temporary structures or equipment, such as tents larger than 60 m² or 645ft²;
  3. 90 days in advance of the special event, if the special event,
    1. requires a special occasion permit or a temporary extension to an existing license issued by the Alcohol and Gaming Commission of Ontario relating to the sale or serving of alcohol,
    2. uses a highway other than a residential highway, or
    3. occurs on Victoria Day, Canada Day, Remembrance Day, or New Year's Eve; and,
  4. Should a special event not include any of the factors listed in paragraphs (1) to (3), the application deadline shall be 30 days.
Separate from the above, if you are applying for the following:

  • Block Party
  • Religious Procession
  • Demonstration/March
We ask that you complete pages 1 to 4 and page 9 of the application and submit it 30 days prior to your event.

Once you have completed the items above, please submit both documents to eventcentral@ottawa.ca or by fax at 613-560-6052.

Once your application documents have been received, a representative from Event Central will contact you to begin the Special Event Permit process.

What is Event Central?
Event Central:

  • assists in the coordination of all city services involved with special events.
  • acts as a first point of contact and one-stop shop for organizers of events in the nation's capital.
  • provides assistance in facilitating permit approvals and coordinating meetings with relevant City officials and other levels of government.
  • coordinates emergency preparedness for events, schedules events so that they do not conflict with similar ones, and communicates with internal and external stakeholders in advance regarding the event's possible impact.
  • works with the Special Events Advisory Team to ensure that special events in Ottawa are successful, safe, and contribute positively to the city and its residents.

Demonstrations
Definition: For our purposes, a demonstration is a spontaneous or planned collection of people using the road allowance as a place to express an opinion. This type of event can be stationary (confined to a specific location) or one which moves from one point to another (commonly referred to as a “march”). Both types of demonstrations are subject to the criteria outlined in this section.
The following conditions apply to demonstrations taking place on City of Ottawa streets.
1. Demonstrations having less than 150 participants shall be restricted to the sidewalk.
2. Demonstrations having more than 150 participants may use part of the roadway. The extent of the road use shall be determined by municipal staff or a police officer.
3. Demonstrations shall not interfere with the passage of pedestrians.
4.
Demonstrations having less than 150 participants conducted outside an embassy or other internationally protected property shall be restricted to the sidewalk on the opposite side of the street. Demonstrations having more than 150 participants conducted outside an embassy or other internationally protected property may use part of the roadway adjacent to the sidewalk on the opposite side of the street. The Ottawa Police shall determine the precise parameters of the demonstration and whether the use of the roadway is required.

The sidewalk directly in front of the embassy or other internationally protected property must be kept clear for security and safety reasons. If no sidewalk exists, the demonstration shall not be permitted within 20 m of the fence surrounding the embassy or other internationally protected property, or if no fence exists, within 20 m of the building face. Depending on the nature of the demonstration, a distance greater than 20 m may be required for security reasons. This shall be determined by the Police Service protecting the embassy or other internationally protected property.

These restrictions are considered appropriate given the special status of internationally protected properties/persons and the increased security implications when a demonstration is occurring in the immediate vicinity.

5.
Demonstrations having less than 150 participants conducted outside a non-internationally protected property shall be restricted to the sidewalk on the opposite side of the street. Demonstrations having more than 150 participants conducted outside a non-internationally protected property may use part of the roadway adjacent to the sidewalk on the opposite side of the street. The Ottawa Police shall determine the precise parameters of the demonstration and whether the use of the roadway is required.

If no sidewalk exists, the demonstration shall not be permitted within 15 m of the establishment. The Ottawa Police and/or municipal staff may make exceptions for small demonstrations or when it is more practical for the participants to be in front of the establishment.

6. Signs or banners, other than plastic foam core signs, must be made of cardboard or cloth/nylon. Plastic foam core signs must be limited to 1.0 cm in thickness, 41.0 cm in width and 61.0 cm in length. All types of signs or banners must be supported by cardboard or softwood supports no larger than 2.5 cm by 2.5 cm. These supports must not exceed 2.0 m in length. The ends of the supports must not be pointed or sharp.
7. In accordance with the old Corporation of the City of Ottawa Noise By-law Number 3-97, the use of sound reproduction devices during special events is authorized between the hours of 7:00 a.m. and 11:00 p.m. so long as the police are satisfied that said devices are being “used in a reasonable manner” (i.e. the volume is not intolerably high so as to unreasonably disturb the peace and comfort of any person in any dwelling house, apartment house, hotel or other type of residence).
8. In accordance with Article 2.6.3.4 of the Ontario Fire Code made under the Fire Protection and Prevention Act, 1997, open air burning is not permitted unless approved, or unless such burning consists of a small, confined fire, supervised at all times, and used to cook food on a grill or a barbecue.
9. Police supervision is required for a demonstration. It is the responsibility of the demonstration organizer to contact the Ottawa Police to arrange for supervision. The demonstration organizer may be responsible for any costs associated with the provision of this service.
10. It is the responsibility of the demonstration organizer, or designate, to ensure that the demonstration does not block private accesses.
11. It is the responsibility of the demonstration organizer, or designate, to ensure that any litter generated as a result of the demonstration is picked up.
12. It is the responsibility of the demonstration organizer to inform the police of his/her name and/or that of his/her designate prior to its occurrence.
13. The demonstration organizer, or designate, must identify himself/herself to the police supervising the event and must be present at the demonstration site until the event is terminated.
14. It is the responsibility of the demonstration organizer, or designate, to ensure that any lawful instruction issued by a police officer is obeyed.
15. It is the responsibility of the demonstration organizer, or designate, to ensure that these criteria are adhered to.
16. The police may require barricades or traffic safety devices at a demonstration site. Costs associated with their delivery, erection and removal shall be borne by the City.
17. The provision of a completed and signed Statement of Indemnification by the applicant or a person with signing authority within the organization making application is required.
18. The demonstration organizer is forewarned that an approved demonstration may be arbitrarily moved or altered in response to an emergency situation. The use of this authority shall not be unreasonably applied.

Special Events on City Streets BY-LAW NO 2001-260
A by-law of the City of Ottawa to regulate special events on City streets.

The Council of the City of Ottawa enacts as follows:

DEFINITIONS
1.
In this by-law,

(a) “Chief of Police” means the Chief of Police of the Ottawa Police Services and includes the officer in charge of any detachment of the Ontario Provincial Police providing police services to the City of Ottawa by agreement, or otherwise having jurisdiction within the limits of the City of Ottawa;
(b) “City” means the City of Ottawa as constituted as a body corporate on January 1, 2001 by section 2 of the City of Ottawa Act, 1999;
(c) “Council” means the Council of the City;
(d) “Fire Chief” means the Chief of the City’s Fire Department or authorized representative;
(e) “General Manager” means the Transportation, Utilities and Public Works General Manager of the City or authorized representative;
(f) “highway” includes a common and public highway, street, avenue, parkway, driveway, square, place, bridge, viaduct or trestle, designed and intended for or used by the general public for the passage of vehicles and includes the entire right-of-way;
(g) “intersection” means the area embraced within the projection or connection of the lateral boundary lines of two or more highways that meet one another at an angle, whether or not one highway crosses the other;
(h) “police officer” means a chief of police or any other police officer, but does not include a special constable, a municipal law enforcement officer or an auxiliary member of a police force;
(i) “roadway” means that part of the highway that is improved, designed or ordinarily used for vehicular traffic, but does not include the shoulder and, where a highway includes two or more separate roadways, the term “roadway” refers to any one roadway separately and not to all of the roadways collectively;
(j) “sidewalk” means all parts of a highway set aside for use by pedestrians or which is used by the general public for the passage of pedestrians;
(k) “special event” includes a demonstration, parade, sports event, festival, carnival, donation station, street dance, residential block party, sidewalk sale, outdoor mass and other like events;
(l) “Transportation and Transit Committee” means the Standing Committee of the Council known as the Transportation and Transit Committee; and
(m) “vehicle” includes a motor vehicle, trailer, traction engine, farm tractor, road-building machine and any vehicle drawn, propelled or driven by any kind of power including muscular power but does not include a motorized snow vehicle, or the cars of electric or steam railways running only upon rails.
SPECIAL EVENTS – PERMIT REQUIRED
2. No person shall participate in a special event on a highway unless such special event is carried on under the authority of a permit issued by the General Manager pursuant to this by-law.
APPLICATION FOR PERMIT
3. (1) An application for a permit shall be filed with the General Manager not less than twenty-eight (28) days in advance of such special event, which application shall:
(a) be in writing;
(b) be in a form satisfactory to the General Manager;
(c) be signed by or on behalf of the person or body organizing, sponsoring or conducting such special event; and
(d) set forth the following:
(i) the date;
(ii) the place and hour of assembly, if applicable;
(iii) the hour of starting;
(iv) the proposed location and route, if applicable;
(v) the proposed return route, if applicable;
(vi) the place and hour of disassembly;
(vii) the estimated number of participants;
(viii) the purpose;
(ix) the number and type of vehicles, including floats and displays, if applicable; and
(x) other information as the General Manager deems appropriate in the circumstances.
(2) The applicant shall provide evidence of insurance, satisfactory to the City of Ottawa, and in accordance with the provisions of clause (d) of subsection (1), prior to the issuance of the permit.
APPLICATION, PERMITS, APPEALS
4. (1) The General Manager is authorized and instructed on behalf of the City to receive applications, to investigate and consider such applications in accordance with this by-law and Council approved policy and if the investigations disclose any reason to believe that the carrying on of the special event may result in a breach of the law, or may be in any way adverse to the public interest, to refuse approval or to approve with such modifications or conditions as the General Manager deems in the best interests of the City.
(2) Prior to making a decision on any particular application, the General Manager may consult the Chief of Police, the Fire Chief, the Manger of Transit Services, and such other persons as are deemed to have an interest in the conduct of the special event.
(3) At least ten (l0) days before the intended date of the special event for which an application is filed, the General Manager shall consider the application and notify the applicant of the General Manager’s decision.
(4) A permit issued hereunder shall specify the nature of the special event, the dates and times, including alternate dates and times, if any, the location and route, if applicable, and the conditions of approval.
(5) Any person may appeal a decision of the General Manager to the Transportation and Transit Committee by filing the request for a review of the decision with the General Manager.
(6) The General Manager shall submit the request to the Transportation and Transit Committee and give notice in writing to the applicant, and said notice to:
(a) set forth the following:
(i) as to the time, date and place of the review hearing, and
(ii) that, if the applicant does not attend the review hearing, the Committee may proceed in his or her absence and he or she will not be entitled to any further notice, and
(b) be served personally or by registered mail to the applicant at the address shown on the application.
(7) The Transportation and Transit Committee shall hold the review hearing at the time, place and date set out in the notice, shall consider the report of the General Manager, and provide the applicant with the opportunity to be heard.
(8) The decision of the Transportation and Transit Committee shall be final.
(9) The General Manager may consider applications filed less than twenty-eight (28) days in advance of a special event, in which event the General Manager shall consider the application, conduct the necessary investigations and make a decision as provided for in subsection (1) as expeditiously as possible in the circumstances.
(10) The General Manager shall approve applications with the same proposed date on a first come first served basis and shall approve succeeding applications in the order received only if the proposed time and location, and route, if applicable, do not conflict and the required police supervision does not exceed available resources.
(11) Despite subsection (10), the approval of applications for demonstrations shall take precedence over all others. not conflict and the required police supervision does not exceed available resources.
GENERAL REGULATIONS
5. (1) The General Manager or the Chief of Police may at their discretion cause to be closed one or more highways or parts of highways to pedestrians or vehicular traffic, or both, and cause to be erected such ropes, barricades and other barriers as may be needed to preserve public order and protect persons and property during the time of such special event.
(2) At any special event, every police officer is authorized and required to take any or all lawful means as may be required to keep or maintain order and prevent obstruction of pedestrian or vehicular traffic.
(3) No person joining in, walking with, riding in or otherwise participating in any special event shall proceed on any highway, or part of any highway in any manner other than as set forth and directed in the permit granted by the General Manager.
(4) No person shall in any special event held upon a highway violate any Federal, Provincial or Municipal law.
(5) No person taking part in any special event shall, during such special event, halt, stop or congregate in such a manner as to obstruct pedestrians not participating in the special event.
(6) Any person taking part in a special event shall obey the directions of police officers safeguarding the proper movement of other persons and vehicles and generally maintaining order.
(7) Except as authorized by a special events permit, all persons taking part in a special event shall conduct themselves in such a manner as to avoid causing any obstruction of traffic or confusion or disorder.
(8) The person to whom a permit is issued under this by-law shall be responsible for the strict observance of all rules and regulations included in this by-law and the permit.
(9) The person to whom the permit is issued shall ensure that no vehicle, float, trailer or other display shall be used in any special event that is of such height as to interfere with official signs, traffic control signal displays, electric, light, telephone or other wires or cables on such highway.
(10) No person shall in any special event held upon a highway carry or display any banner, placard, flag, insignia or other similar device of a character or nature calculated or tending to engender disorder or strife or to offend public morality.
(11) Special events shall, unless otherwise approved by the General Manager, march or travel on the right-hand side of the highway, leaving room for other traffic thereon to pass.
CONDITIONS
6. (1) All permits for special events issued by the General Manager shall be subject to the following conditions:
(a) the applicant shall be responsible for the erection, maintenance and dismantling of all barricades required by the General Manager or Chief of Police;
(b) the applicant shall pick up any and all refuse generated as a result of the special event held upon a highway;
(c) the applicant shall pay for such costs as may be imposed by the Chief of Police for policing required during a special event held upon a highway;
(d) the applicant shall provide and maintain Comprehensive Liability or Special Events Liability insurance subject to limits of not less than Two Million ($2,000,000.00) dollars inclusive per occurrence for bodily injury, death and damage to property and such insurance shall be in the name of the applicant and shall name the City of Ottawa as an additional insured thereunder;
(e) the applicant shall enter into an indemnification agreement with the City which agreement shall indemnify and save harmless the City from and against all manner of actions, causes of actions, claims, demands, losses, costs and suits that may arise, be sustained or prosecuted against the City for or by reason of the granting of such permit; and
(f) such other conditions as the General Manager deems appropriate in accordance with the Council approved policies.
(2) Every person to whom a permit is issued shall comply with the conditions prescribed by subsection (1).
ENFORCEMENT AND ADMINISTRATION
7. This by-law shall be enforced and administered by the General Manager and the Chief of Police.
OFFENCE
8. Every person who contravenes any of the provisions of this by-law is guilty of an offence.
PENALTIES
9. Every person who is convicted of an offence is liable to a fine as provided for in the Provincial Offences Act, R.S.O. 1990, Chap. P .33.
10. When a person has been convicted of an offence under this by-law,
(a) the Ontario Court of Justice; or
(b) any court of competent jurisdiction thereafter, may, in addition to any penalty imposed on the person convicted, issue an Order prohibiting the continuation or repetition of the offence by the person convicted.
BY-LAWS REPEALED
11. The following by-laws are repealed:
(a) Part 2.9 entitled “Parades and Special Events” of Chapter Two of the Regional Regulatory Code of the Old Regional Municipality of Ottawa-Carleton, and
(b) By-law Number 96-3 of the Village of Rockcliffe Park entitled “A by-law of the Corporation of the Village of Rockcliffe Park to regulate parades and processions in the Village of Rockcliffe Park”, as amended.
SHORT TITLE
12. This by-law may be referred to as the “Special Events By-law”.
ENACTED AND PASSED this 11th of July, 2001.

A "special event" under By-law No. 2013-232 means a fair or festival, or a social, recreational, educational, community or similar event that is occurring outdoors on any property that is not a city street / sidewalk and having an expected attendance of at least 500 persons at any one time during the event, and includes a Beach Event.

If your event has less than 500 people in attendance, please note that Event Central can still assist you with the coordination of City Services for your event.

Events taking place on a city street / sidewalk are subject to the conditions under By-law No. 2001-260. A “special event” under this By-law includes a demonstration, parade, sports event, festival, carnival, street dance, residential block party, sidewalk sale, outdoor mass and other like events;

Based on the size and complexity of your event sufficient notice is required to process your application. This ensures that all facets of your event are able to be addressed in order to deliver a safe and successful event.

When do you need to apply?
If your event has an expected attendance of at least 500 persons at any one time or is taking place on a city street/sidewalk

If you are planning a special event in Ottawa, you will need to complete and submit a special event application to the Event Central office prior to your event.

Application deadlines:

  1. 30 days in advance of the special event, if the special event,
    1. includes pyrotechnics or fireworks,
    2. includes the preparation, storage, handling, serving or sale of food or beverages,
    3. includes one or more vendors of any type,
    4. includes or uses one or more vehicles,
    5. uses City property, or
    6. includes open air fires
  2. 60 days in advance of the special event, if the special event,
    1. uses property owned or leased by the Provincial or Federal government,
    2. requires a noise exemption pursuant to the City's Noise By-law,
    3. uses or includes aircraft, watercraft, or helicopters, or,
    4. includes or uses temporary structures or equipment, such as tents larger than 60 m² or 645ft²;
  3. 90 days in advance of the special event, if the special event,
    1. requires a special occasion permit or a temporary extension to an existing license issued by the Alcohol and Gaming Commission of Ontario relating to the sale or serving of alcohol,
    2. uses a highway other than a residential highway, or
    3. occurs on Victoria Day, Canada Day, Remembrance Day, or New Year's Eve; and,
  4. Should a special event not include any of the factors listed in paragraphs (1) to (3), the application deadline shall be 30 days.
Separate from the above, if you are applying for the following:

  • Block Party
  • Religious Procession
  • Demonstration/March
We ask that you complete pages 1 to 4 and page 9 of the application and submit it 30 days prior to your event.

Once you have completed the items above, please submit both documents to eventcentral@ottawa.ca or by fax at 613-560-6052.

Once your application documents have been received, a representative from Event Central will contact you to begin the Special Event Permit process.

What is Event Central?
Event Central:

  • assists in the coordination of all city services involved with special events.
  • acts as a first point of contact and one-stop shop for organizers of events in the nation's capital.
  • provides assistance in facilitating permit approvals and coordinating meetings with relevant City officials and other levels of government.
  • coordinates emergency preparedness for events, schedules events so that they do not conflict with similar ones, and communicates with internal and external stakeholders in advance regarding the event's possible impact.
  • works with the Special Events Advisory Team to ensure that special events in Ottawa are successful, safe, and contribute positively to the city and its residents.
