Crane company fined after dramatic Kingston fire

The employer of a crane worker who was whisked to safety by helicopter during a massive fire at a Kingston construction site in 2013 has been convicted and fined for failing to co-operate with a Ministry of Labour investigation.

The fire on Dec. 17, 2013 at an apartment under construction on Princess Street left the crane worker stranded in his cab, 100 metres above the ground. As horrified onlookers watched, the man was forced to make his way to the end of his 65-metre boom as the flames and smoke intensified. He was eventually lifted to safety by a military search-and-rescue helicopter that arrived from CFB Trenton.

His employer, A & A Cranes Inc. of Waterdown, Ont., and its owner, Aram Malek of Hamilton, were later contacted by Ministry of Labour inspectors, who requested various documents related to the project. When not all the documents were supplied, the company and Malek were charged.

On Thursday, Malek was convicted of two counts of Occupational Health and Safety charges: supplying false information or refusing to supply information to an inspector, and; failing to facilitate an inspector’s investigation. The convictions carry fines of $10,000 and $9,000 respectively.

A & A Cranes was convicted of failing to comply with an inspector and fined $8,000. The case was heard in Hamilton.
