Calypso Water Park has been fined $400,000 for a series of safety violations in the summers of 2011 and 2012 that left some riders seriously injured.
Ontario Justice of the Peace Julie Lauzon handed down the hefty fine Monday after Calypso was found guilty of six safety violations in April.
The violations included operating one water slide that posed a danger to its riders, as well as having undertrained staff. The water park was also cited for failures to report serious injuries to the authorities and not shutting down a ride promptly after a series of accidents that left riders seriously hurt. Lauzon stayed two of the six charges of which Calypso had been found guilty, as she determined that those offences were similar enough to other offences that they didn’t require a separate fine.
“The maximum total fine could have been $4,000,000. A fine that is 10 per cent of the maximum fine, for a first offender, is reasonable in my view,” wrote Lauzon in her sentencing decision.
“The fines I am imposing for the remaining four counts, in my view, will adequately cause the Defendant to realize the importance of knowing, understanding and abiding by all sections of the Statute and regulations that apply to the business in which it has engaged,” Lauzon wrote. “That is the paramount purpose of sentencing this Defendant: to instill full respect for public welfare legislation that is in place to ensure the protection of the relatively vulnerable public that attends its facilities.”
Water slide rider Sophie St. Jacques suffered a broken vertebra as a result of an accident on the Steamer water slide. Another accident on the Bobsleigh ride in 2012 that involved two rafts colliding left rider Marek Strelec unconscious and in hospital for three days.
A prosecutor asked Lauzon to fine the water park $850,000 for the safety violations, arguing Calypso was more interested in its own bottom line than public safety. Calypso’s lawyer Lawrence Greenspon said the park has suffered massive financial losses and negative press as a result of the offences, and asked for a fine of between $125,000 to $150,000.
The park, which is in Limoges, had faced 20 charges, but nine were withdrawn during the trial by the prosecution. Lauzon acquitted Calypso of another five.
The water park is still facing several civil lawsuits stemming from incidents on their slides.

It is the second time the park has been hit with a heavy fine this summer. On June 4, the park’s opening day for the 2015 season, Calypso was fined $100,000 after pleading guilty to two charges under the Environmental Protection Act for a pair of chlorine leaks into a wave pool in 2012. The leaks sent 13 people, including several children, to hospital with symptoms including shortness of breath, burning sensation and pain in the mouth, nose, eyes, throat and lungs, nausea and headaches. Seven others were injured but didn’t require hospitalization.
