A successful court appeal means the city is once again on the hook for $2.24 million in a legal dispute with the owners of a sports dome.
The dome owner, Coliseum Inc., challenged a Superior Court decision that overturned an arbitration ruling on a contract between the company and the city.
The dome covered the field at TD Place before the Lansdowne Park redevelopment. When construction started, the dome was left without a home under an active contract with the city. The company and city couldn’t agree on terms for relocation.
The Ontario Court of Appeal released a decision Friday that says the arbitrator’s original decision in favour of Coliseum should stand. The court also awarded Coliseum $36,000 in legal costs.
The city is deciding if it should pursue an appeal at the Supreme Court of Canada.
The dome has since found a home at the RA Centre during the winter months.
