朋友最近买了一个CONDO,在签PURCHASE AGREEMENT 的时候发现包括的电器少了窗式空调,因在MLS 的广告上是写明包括空调的。 当买主向其AGENT提出此问题时,AGENT 说没关系的,广告上有的而卖方又没有在AGRREMENT上面EXCLUDE里列出的话,就表示包括了。而买方AGENT还特意在第二天和卖方AGENT核实此事,对方AGENT也认为如此。

(签AGREEMENT的时候卖方要求把窗帘及过滤器写在EXCLUDE里)。

但事后卖方把空调带走了,其理由是AGREEMENT 上没有就表示不包括,同时还把一个钉在墙上的架子也拆下来带走,墙上留下两道各一米多长的痕迹,必须把整个房间从新粉刷才能把那两道丑陋的疤痕盖上,因为现在的墙是彩色的。

买方AGENT向卖方AGENT询问此事时,对方AGENT否认曾经确认空调一事。

请大家谈谈此事应如何解决,是否可以通过法律途径把空调及架子要回?
 
这时候就看出你的agent的水平,和是不是出力维护自己客户的利益了。
 
另外,如果律师那里还没有交接,不妨要求律师停下。
卖方马上就会急了。

I have the unhappy experience with the one agent. She told me on the house showing day what is going to stay and what the owner is going to take with him. However, when she put into purchase agreement, she did not list the same way as she said. When everything went through and I found out the missing stuff on the last review day and then asked the agent why the owner took out something which should stay. After we argued with the owner on this, the onwer brougt out the agreement and denied that he ever said that way. The agent then standing on the seller's position and said teh stuff does not cost much and she could do nothing about that. She re-directed us to our lawyer to settle this down if we like and refused to do any work from her side.


I feel some real estate agents are trying to take advantage of new immigrants from China with less expereince and are not good in English. They simply want to grab the quick money out of your pocket and do not care about your interest at all. Of course, they will not say that way. Instead, they tried to mislead you emotionally to a trap. For first time buyer, I would strongly suggest to choose real estate agent carefully. If you do not feel comfortable or have any feel about by cheating, walk away immidiately.
 
对,很多AGENT确实象你说的那样,为了赚钱误导买主,特别对新移民,更是如此。

这个AGENT我以前用过,感觉很好,人很耐心,所以才建议朋友用她,殊不知日久见人心,现在才发现她的问题,太过软弱及两边倒,一味对卖方退让,不惜牺牲买主的利益。因是我的主意,所以内疚。:(

原来还想把她的CONTACT贴出来,推荐给大家,现在才知道庆幸当初没那么做:p

倒不是为了发牢骚,只是想大家出出主意,有没有可以通过法律途径来解决的办法,总觉得加拿大的法律更多的保护买主,而卖方这次是明显的不诚实,不应该这么容易就让他们GET AWAY了。
遇到这样的卖方确实很倒霉,我有朋友也有类似经验,交房子的时候发现壁炉上的网子被拆走了,问老房东,人家说单子上没有列,她担心回头再要她来拆,于是就事先拆了扔了…买房子的觉得那时壁炉的一部份,可是老房东知道不是谁家都安,那个是她自己加上去的。你怎么追究她的法律责任呢?
我觉得这个事情中难说通过法律途经解决,倒是买方agent的水平,卖方agent的职业道德值得追究。
 
没错,。 买方代理太软弱,而卖方代理有职业道德问题,

还有卖主,明明广告里写明包空调,如真想留下,会写在EXLUDE 里了, 就象他们留下的过滤器和窗帘一样。

这个帖子也给要买房子的人提一个醒--AGREEMENT里能想到的都写上,以免成交后有损失。

I think it is invaluable to share our experience each others by listing on this CFC. This is the lesson we should not make the second time. We should also help each others in this small Ottawa Chinese community not to make the similar mistake. We have the right to be treated well and fairly. Those cheating and unethical real estate agent should learn soon that cheating Chinese immigrant won't get them any good result, they will lose our business as the punishment for their wrong behaviors. By doing that, we Chinese newcomers could become stronger.

Anyway, on Canada house marketing, Chinese immigrants plays a majority part to keep them healthy. We contribute this community and should have rights to be treated equally.
 
请问下OFFER时所交定金是给买方AGENT, 卖方AGENT还是卖方律师? 能否选择?
 
订金应该是在买方agent手里的。

这个问题难说就在于,如果一方没有agent呢:rolleyes:
所以我觉得是在卖方或者其代表那里。
