The official account of NYPD Hate Crime Task Force confirmed Elliot's arrest: "Thanks to assistance from the public and excellent investigative work by @NYPDHateCrimes Detectives, the individual wanted for Monday’s assault of a 65 year-old Asian female, at 360 West 43rd St, was arrested and charged with Felony Assault as a Hate Crime," it tweeted.
As reported by the
New York Post, Elliot lives in a nearby hotel that serves as a homeless shelter. He crossed paths with the woman on West 43 Street near Ninth Avenue on Monday morning, where he hurled anti-Asian abuses at her first, before attacking her. Elliott yelled "F**k you, you don’t belong here" at the woman, according to the police.
The victim's daughter's boyfriend, Luca, said he locked eyes with her as she she tried to avoid him. "She said he was walking towards her and he locked eyes with her,” he explained. "She tried to avoid him, like how people do when you walk in New York City, but he came right for her. After the first hit, she wasn’t even there," he added. The video footage shows that he kicked her to the ground and then proceeded to stomp on her several times.
The attack was caught on camera and there were several witnesses, including staff of a residential building in front of which the attack took place. However, as the footage showed, no one came forward to help her.
The Brodsky Organization, which manages the building, posted a statement on Instagram addressing the attack. The post said that the organisation "condemns all forms of discrimination, racism, xenophobia and violence against the Asian-American community." And that "the staff who witnessed the attack have been suspended pending an investigation in conjunction with their union."
