我现在有一烦心之事,去年11月底我买了个房子。当时天气冷没发现漏,现在发现漏。我找了经纪人,他说:房子卖了他管不了。维修房子的人说(白人):维修房子费用应该由卖主负担,我是否可直接找卖主谈,如果谈不成打官司是否可找回公理?
 
How old is your house? is it still under warranty? or did you use the house inspection before you signing the contract?

Here are few steps you can do. Find a professional (contractor or home inspector) to find out what cause the leakage, how severe is the leak? and how long it has been leaking?

If you can establish the leak has been going on for a while, and the previous home owner aware of the leaking problem, but he failed to disclose the information to you. Then you can held him liable for misrepresentation, he/she is liable for the damage caused to you.


Did you hire a home inspector when you bought the house? If so, I wonder if he has Errors & Omission insurance to cover such unseen problem?

昨天我外出回家,去地下室查看差点气晕了,三分之一的地下室是水,我一下子体
会到叫天天不灵,叫地地不应,怒发冲冠是什么感觉,当时都有要杀人的念头(真是
气急了)。
我现在准备和平解决,不行我将把经纪人和卖方告到法庭,他们不仁我也不义,同
时我也将把经纪人和卖方公布于众,不要象我一样再受他们的骗。
维修房子的人说(白人):我肯定能胜。因为他遇到很多次象我这样的情况,如有必
要愿为我做证。

我很理解你的心情。我爸妈家给淹过好几次,老房子就是会有这种情况。你现在还在气头上,似乎不利于解决问题。先平静下来,该怎么办怎么办:联系经纪人,联系卖方,收集有利于你的资料,证据。各条路都走过后还不能解决问题就寻求法律手段。当真到了那一步,如果可以争取到维修房子的人作为你的人证恐怕胜算更高。水灾通常是在房屋保险范围之内,最坏的情况也是申请保险,个人损失有限,只不过象照片一样不能挽回的东西就没了,的确很让人心烦。

临时的补救办法是将房子周围临墙缝的地方将地势加高,形成一个从里向外的斜坡,让水往外流。去Home Depot买点种花的土就行。春天化雪的时候最容易产生水灾。

公布于众之语想是你的气话,我不赞成这种行为,而且有可能惹上更多的麻烦。当然你可以用悄悄话通知其他人。

齐流到地下室 。维修房子的人说:靠地下室下方的墙壁有条裂缝,很有可能是他装
修地下室时敲裂了,而且他一直也没修,同时房子外墙和车道地下是有一部分是空
的(他用东西敲给我们听,发出的声音是闷声),凡是从房子周围临墙缝的地方流下的
水聚到这个空洞里。

Did you hire a home inspector when you brought the house? Some house inspector carried Error and Omissions Insurance to conver this type of concealed problem.
 
我有inspector,他没有错。是卖房人欺骗。经纪人在卖房给买方时少了一道程序,卖
方经纪人有失职过错。

I did a google, and found a link posted by a home owner that had similar situation. There are seventeen postings for this thread. Make sure you read all of them.

Most of the comments were posted by Americans; howevre, there are some from Ontario as well. Someone suggested that Ontario has a law regarding the full disclosure of known problems of a resale home; ex-owner and the sale agent are liable for the problems that were not disclosed to the buyer. Most people suggested to find a "good" lawyer - someone that is reputable in real estate law practice. In Ottawa, most lawyers will offer free first time consultation; you may want to take this adventage to select a good lawyer and to find out if there is a court case for your situation, and what is the legal cost.

As for the home inspector, eventhough is not his fault. He may have insurance to cover this type of hidden problems. Why not give hime a call? He /she did the inspection for you, in a way, he/she is partly responsbile for the problem (not may legally, but morally). He/she might able to give you some good advices

I passed your problem to a friend who is an agent himslef..he asked if the previous leaking is reported in the SPIS (seller property information statement)...if it is not, then that means the seller was cheating...if it is, there should be detailed info on when the defect was fixed and fixed by whom...

He suggest you should solve this problem with the seller rather than by the lawyer who is probably charging you more than the cost of the fix...

Of course, 卖方经纪人有失职过错..

But I think both your agent and lawyer (maybe your inspector as well) have 失职过错...if you cannot push 卖方经纪人, then push yours...
