Another new immigration bill tabled

OTTAWA - Cabinet will no longer be able to take away Canadian citizenship under a new bill tabled Thursday morning in the House of Commons.

In introducing the bill, Immigration Minister Denis Coderre became the fourth Liberal minister to try to overhaul the existing Citizenship Act.

His proposals include taking the power to strip Canadians of citizenship away from cabinet and giving it to the courts.

The immigration minister, however, would be able to annul citizenship for people found to have lied about their identity. That power could be exercised for five years after citizenship was granted.

In other, less straightforward cases, the courts would be able to take away citizenship from anyone found to have been involved in terrorism, a war crime, or organized crime. The courts could also order such a person deported, Coderre said.


Under the new bill, residency requirements are loosened, to allow more flexibility for people who have to work outside the country, Coderre said.

The current law requires prospective citizens to be physically inside Canada for three of the preceding four years. That would change to three years of the preceding six.



Other changes would include a requirement for children of Canadians born outside the country to apply for citizenship, and a new pledge of loyalty to Canada.

The current oath taken by new citizens was written in 1947 and doesn't mention the country.

Three other immigration ministers have tried to overhaul the 20-year-old act. The last attempt, in 2000, died when the federal election was called.
