[问题] need a lawyer

Any one knows any family lawyer who speaks Chinese
and is familiar with both Chinese and Canadian laws
about divorce?

Some lawyer told me if I authorize my relatives in China
do it for me, the Canadian government will not admit it.
We have to go back to China to do it by ourselves or ask
a lawyer here to do it for us. Is that true? The fee charged
by the lawyer is over $1k. :flaming:

First, if you want to divorce here, you should have been in Ontario for over one year.
Second, the lawyer fee is over 1000 for this.
Third, if you are low-income family, you can ask for Legal Aid for help.

Fourth, if you two can sign the document peacefully, you can DIY: Buy document first, hand on together and wait for result. Go to ontario court on Elgin street and ask for detail.

Thanks for your suggestion. The problem is
we got married 7 years ago in China. Now my husband
is in USA and I am a Canadian citizen. Can we go to
a court here?

I believe you can file a unilateral divorce from Canada, but check with a lawyer to make sure.

Divorce Act 4-1: Jurisdiction in corollary relief proceedings

4. (1) A court in a province has jurisdiction to hear and determine a corollary relief proceeding if

(a) either former spouse is ordinarily resident in the province at the commencement of the proceeding; or

(b) both former spouses accept the jurisdiction of the court.

好像是说任何一个省级法院都可以审理离婚案，如果任何一方曾经在该省居住过；或者双方达成协议接受该省的权限。
