我有这样一个问题，不知道谁有错。在丁子路口，有一个行人过马路，行人的方向是绿灯，但绿灯下面的小手一闪一闪的，提醒行人快变灯了。但这时有一辆汽车试图做红灯右转，汽车司机应当先查看路上是否有人过马路，但汽车司机可能忽略了没有看到行人，碰到了行人。过错方应当是司机吧。我想知道，行人是否也有错。就是说，在小手一闪一闪时应停止过马路。

well.. in 99% of accident, both parties are all fault.

Car owner, should look more careful.
Pedestrian, should watch the car to avoid accident.

But in this case, i think is the pedestrian who get hurt and also it is still in his/her procession, and will become the winning-side. But it all depends on situtation. ( Don't quote )

The key point is that when the pedestrian light changed from "Hand" to "Flashing", before the walker started to cross the road, or after? If the former, most of the fault goes to the walker; otherwise, 100% fault goes to the driver.

感觉司机应负主要责任。在行人步入人行道的一瞬间“小手＂是否在闪是行人是否违反交通规则的标志，但红灯右转视同“Stop Sign”，司机必须首先Full Stop，然后观察路面，在确保安全的情况下（如果有行人站在人行道旁，要确保行人不过马路的情况下），方可启动。假设汽车与行人同时启动，由于汽车刚启动，速度较慢，撞上行人的可能性不大。所以如果能证明汽车在右转时，没有完全停下，那样司机应负完全责任。如果汽车先启动，行人在“小手”闪耀的情况下跑过人行道，大概行人要负主要责任。

汽车司机负全部责任.
原因: 行人绿灯拥有路权, 而汽车是红灯无路权. 红灯右转的前提是与有路权的人和车不冲突并且能确保安全.
很显然汽车司机违背了上述前提.
