closing date 前两天房子被水浸泡

不知道算运气好,还是运气不好。我们前两月购买的房子本来是明天就要CLOSE的,结果昨天房主通知我们的律师说房子内被水淹了。原因是masterroom里的厕所漏水,大概漏了一天,水已经都漏到了地下室。我们去看得时候,地下室的地板都拆了。

我想请问一下大家

我们如果要take这样的房子的话有什莫风险? 要注意些什莫?

如果不要的话,有什莫办法能要回我们的押金?

congratulation. you have very good luck.The damage should be taken care of by their insurance. You basically have a new basement. I think you spend lot of time for searching that house and buy it for a good reason, you just give it up that easily. A house is not a car which is a mass production product. It will have some problem here and there, even a new home would have some problems. Basically a house ownership is willing to spend money to fix or upgrade things year after year. Think of that way, it is them have to fix it not you.
 
A friend (seller) had similar situation. The buyer still took the house. The seller's insurance covered the damage and they hired professional company to do the cleanup and fixing.

Currently, the insurance company (RBC) from the seller side hires a contractor to fix the problem. The seller emailed us a very detailed fix plan provided by the contractor today which lists what need to repair in a cost of over $20,000.

The report says the water went to part of the master-room, damaged part of the hard-floor in the living room, and counters and floors in the kitchen. And the whole basement almost needs to redo.

My concerns are:

1) how much the chance that the house will get molds in the future?
2) Is there any chance that the wood structure of this house being affected?
3) how can I ensure the quality of the project?
4) Should I ask the seller to cover all the extra fee (lawyer fee, inspection fee etc..) if I decide to take the house?
5) If I want to sell this house in a few years, will this accident affect the selling price?

Nothing to worry about. after wood dry it is all OK. You can inspect the job when they are doing it and after job is done. I don't think they will cover your extra fee like lawyer fee if you have to pay it anyway. Most insurance plan will cover rental cost if you lose total usage of the house. But according to report you still can live in it.

You would still take the house on closing day or it would be delayed?
 
the first closing date was already postponed to today. According to laywer's advice that we need to decide whether postpone the second closing date to June 29th when most part of the house repaired.

Nothing to worry about. after wood dry it is all OK. You can inspect the job when they are doing it and after job is done. I don't think they will cover your extra fee like lawyer fee if you have to pay it anyway. Most insurance plan will cover rental cost if you lose total usage of the house. But according to report you still can live in it.

还好您在这说了这事情, 我正买个旧房, 所以在购买合同中又加了与这种突发事件有关的条款. 谢谢您分享您的经历, 也提醒大家在买房时都多个心眼.

多问一句, 你是通过AGENT买房的吗? 那是不是就签了代理的标准合同? 有没有加入有关突发事件的条款?

我在合同中加了, 但对方的律师对这条很有意见, 弄得卖家和买家都不开心.
