Looking for advices for a car incident at parking area. The following is what hapened:

While my car was parked in a parking area (without yellow lines) in Monday, a Indian lady was backing up her car and hit the left front side of my car. I went into a building to find a witness for it. Meanwhile, the lady asked me not to make the claim through insurance company and she said she will pay after I get the estimated price. However, now, she does not want to pay and also deny the fact that my car was parked there when her car hit my car. Moreover, she said the witness can not see what happened from inside. Please advise me what I can do for this case. Thanks.

Call the woman up and tell her you are going to report this to the police, tell the police what happened.

Did her car also suffer damage? The police can match up the damage to both of your car.

If you have her plate number, or driver's license number and insurance company name and policy number(important), simply call her insurance company. You may not need to have a witness if you get her insurance company name and policy number. If you do not have these numbers, try to find her address with her phone number and then get her plate number. Never trust anyone here. Always ask for the plate number, driver's license number, address and insurance company name and policy number(make sure that it is valid). Also talk to an agent if you have one.

哎， 我4年前在多伦多也遇到一模一样的情况，事后打电话过去连接都不接了。看来这种行为在阿叉中间是普遍行为。对阿叉确实不能动恻隐之心呀。。

如果你有她的保险信息(而她没有你的), 就等于她已经承认了责任. 否则, 可以报给警察(613-236-1222)来处理. 不用担心, 警察去了她就会乖的.

one thing you did wrong was that you failed to call your own ins co after accident
you can also call a police at the time of acc and the police will allow you to settle that too
the co allows you to settle between you and the other party

看来这种教训很多呀。我１０年前刚来加拿大时，有一个老白开一个大卡车，停在我们车旁边。我正好回到车旁，看到那个人打开他的车门，把我的车门给撞了一个小坑。我说你把我的车碰了，他开始不承认，我让他打开他的车门，一对，非常match。他马上改变态度，向我道歉，和楼主说的一样，让我去bodyshop做一个估价，他来付，我留了他的车牌，驾照，他说车是从他亲戚那儿借的，因此没带保险号，说打电话告诉我。等我办完估价，打电话给他，他一口拒绝，说没有witness。最后打给我的保险公司，保险公司说没有对方保险号，没法受理。找警察居，警察说没有证人，数额太小，没法立案。最后不了了之，自己付了３百多修车。从此，我不再相信任何借口，以后几次事故，不是叫来警察，就是要对方保险号。

Thanks very much for all of your advices. In fact, we exchanged all information including insurance policy #, name, telephone and address, etc. Moreover, both I and the Indian lady also went to policy station yesterday. However, the lady just denied the fact at the front of the policy, and the policy could not do anything. The policy even didn't make a policy report for me, and the policy didn't want to call my witness. Anyway, the policy didn't do anything except giving me a so-called case #.

Of course, I can make the claims from the insurance company but my insurance premium will increase by about 40% during the next 6 years. It is just not fair for me. If I don't make the claims, I will bear all the repairing costs ($1150), and the Indian lady just escaped from her careless driving.

Please post your ideas here about how to make the Indian lady bear the costs from her careless driving and wrong doings.

If you have the police case number, call your insurance company and report that woman's insurance information and the case number to them. Your insurance company will call the police for confirmation.

Tell them that if she denied, then why would she exchange insurance in the first place, this means she has something to hide.

I had similar incident 2 years ago.

I reported the incident to my insurance company, tell them exactly what had happened(tell them the other parties Name, plate number, and contact info) . but I forget got her insurance policy #.

I went to body shop, repaired my car (1-2 weeks), and get rental car as well. Paid the body shop (some 700-800 bucks), and I did not have to pay the rental at all(signed my name there and walk away - my insurance co took care of the bill).

Eventually, I called my insurance company, told them it's not my fault. they asked the her insurance policy number which I forgot in the first place. So I called her, and as you know, she just ignored me and never give me the number. I called my insurance co, and told them I can not get the number. They asked me wait 2-3 days, and I got my money back.

And you know, because it's NOT my fault, my insurance did not increase a dime. Sweet eh?

Lessen learned: never solve the problem in private. I mean NEVER. The insurance company will make you comfortable, not frustrating. It's far more esier than you think if you follow stardard process.

给保险公司打电话，让保险公司来处理。这不是你的责任，你的保险应该不涨。

此外，即使你的保险涨了，修车的钱和以后的保险对消了。等于你没有报告，只是bite the bullet。

俺也有这样的事情，不过是俺的错。当时天黑，也没有叫警察。不过，我的保险是涨了些大约每年300。
