问问关于租房之后开收据的问题...

我的房东是个罗马尼亚单身的,53岁的老女人。一开始来的时候是类似一个中介公司收钱之后住进来的。类似于必须的方式,至少住四个月。开头要交第一个月和最后一个月的房租。我想让老太太给我开收据退税。她死活不愿意。可能是因为不想让政府知道自己有这么多一项收入的原因吧。

我知道一般来说有些房东不开收据,但是一开始会和房客说好,我的房东一开始没跟我说过这个事情,我当时也不知道,后来交了钱了才晓得有这么一回事。那么我的问题是...在加拿大的法律上,或者根据有关部门规定,房东在房客所要收据之后是不是一定...必须要开呢???还是可开可不开???

如果一定要开,她没有执行,我应该去哪里申诉?或者说是告她??我并不想告她,只要拿回我的收据就好..呵呵,详细了解一下。主要是为了说服她。如果她真的不愿意,我才会考虑请求法律援助。希望各位大虾不吝啬赐教。小弟跪谢。

顺便问问...我跟房东说好之后,如果她愿意开,但是没有recipe book,写在一张纸上可以吗?具体格式需要咋样???
 
one more question for COLA,新的那个标准上面在哪里差关于房东是否有义务给房客收据的问题?我进去了LAW这一方面,找不到啥资料~

还有一个就是能否解答下这个收据的具体形式,是不是一定要用RECIPET BOOK??

Q. What happens if you claim rent, but that person doesn't claim rental income?
A.
The recipient of the rental income is responsible to report this income if this is a rental situation and not a cost sharing arrangement. If you are not being charged fair rental value and are renting from a family member, it is probably not a rental situation. Therefore, you cannot claim rent.
If it is a true rental situation, you can claim rent, but must be able to provide a rent receipt upon request from CCRA. Your rent claim for purposes of the Ontario Property Tax Credit is not based entirely on the existence of a rent receipt. Within the next two years after your tax return is assessed, CCRA may ask you for your rent receipt to verify your claim. If you are able to provide a receipt or cancelled cheques, your claim for the Ontario Property Tax Credit will be not be changed, as long as the rent has not been paid to a family member and the amount paid qualifies as rent. If you cannot provide a receipt, your claim for rent may be denied and you may have to repay a portion of your refund. If you are entitled to the deduction, CCRA will then go to the person to whom you paid the rent. Allow your rent claim in the absence of a receipt if you can provide details of the rental situation.

Q. If I didn't get any receipt from my landlord, do I need to ask for one? (Note: I wrote a cheque to her every month, and on my cheque, I indicated, "Rent for Jan.").
A.
As noted in the previous question, you may provide a receipt or Cancelled cheques are an acceptable form of receipt to prove that you paid rent. However, ensure that the address of the rental unit is indicated on the cheque, in addition to the name of the payer and the month and year for which you have paid rent. You may also submit a letter from the landlord/landlady. Refer to Information for Ontario Residents in the Forms Package.
