How to resolve a car accident

Hi,

I need help on how to resolve a car accident that happened in Ottawa downtown last night. a car was illegally park on a one-way street and as I was trying to turn into the street, my car's side mirroir accidently collided with the parked car's side mirroir. Both mirrors were broken and require repair. The parked car's driver and I exchanged our driver licenses' info. The Ottawa driver requested that I paid for the dommages. Today his car insurance company called me regarding the accident. I haven't returned the call and would like to get some help/advice on how I should handle this accident.

I live in QC and therefore has a QC license. In QC, when an accident occurs, we need to inform the police and fill in a report, before we could report the accident to our insurance company. In this case, the police was not called upon and therefore a report was not completed. The ottawa driver only has my phone number and my driver license information, without a police report, can he still request that I pay for the dommage? If I need to pay for the dommage, is there a way to resolve the issue without involving the insurance company? I do not want to leave a record.

Please help.
 
I don't know if you can "not leave a record" if the insurance company has already been contacted.

I believe it is your responsibility, regardless of his parking situation.
 
why not call the police last night?
now he phoned his insurance company probably told them his story and the best thing u could donow is calling urs and tell them ur story.
 
Because he illegally parked his car, wouldn't he be partially at fault? (I think this is why he didn't call the police)

If a police report was not filled and he only has my driver license, can I ignore the call from his insurance company then?

Would I still be able to resolve the issue in private, not leave a record.
 
If that car was indeed parked illegally, you have the right to call city or police to issue a ticket or even tow it away. However, you have no reason or justification to damage that car.

Anyone who drives should do so in a safe manner. If there was not enough space to drive/pass-thru, you should have stopped and horned to let the owner move it or simply take another route (if available).

From insurance company's view, that car was parked and your car was moving when this happened, therefore you are 100% responsible for this collision.

If you want to settle the matter in private, you should have discussed it with the owner of that car at that time. After that person already contacted his insurance company, it's too late.
 
In Ontario, if the damage is less than $1,000, it is not required to call police on site.

Sicne the other party already called the insurance company with your insurance policy information, there was a record anyway. If I were you, I would call my insurance company and described how the accident happened and let both insurance companies determine which driver/car was at fault.
