紐約出生 哈佛法律系畢業 工作13年 申請在加定居亦要考語言能力

她的母語是英語。不過,與申請在加拿大定居的其他的技術移民一樣,這名美國的公司律師必需參加語文試來證明她的英語程度足以在本地居留。

羅賓斯在紐約的Benjamin N. Cardozo Law School取得法律學位,目前持工作簽證在多倫多為1家國際的金融服務公司擔任合規及規例律師。她表示感到憤怒及侮辱。

她說:「我幾乎從椅上跌下來。我多年來在這裡當律師,而我必需要證明本身的英語能力?」

上月,聯邦政府規定所有技術移民的申請人必需要參加語言能力試,而母語為英語或法語的人士也包括在內。

這項部門指示規定,由6月26日開始,負責的政府人員不可以處理沒有語文試結果的申請。

這些考試是國際英語測試(International English Language Testing System)及法語的TEF,將會影響數以萬計的來自英語及法語國家的移民申請人。

本月較早時,多倫多移民律師蘇偉基(Cathryn Sawicki)向聯邦法庭申請就有關的指示的合法性進行司法覆核。該司法覆核申請指稱語文試的指示違反了加拿大移民法。
 
移民局有时候是挺昏头的,我认识一加拿大大学教授(英语地区的学校)申请移民,移民局居然要他去考雅思。
 
法律面前人人平等. 有这时间去抱怨, 早就考试通过了.

Liberals, NDP support race-based hiring

OTTAWA - The Liberals and NDP are condemning a move by the Tories to end government hiring practices that block some people from applying for jobs based on race.

Treasury Board president Stockwell Day says no Canadian should be blocked from getting a job based on their ethnicity, but the Liberals say the Tories are just trying to meddle with the public service.

Earlier this week, QMI Agency published a story about an Ottawa area woman who was shocked to learn she was barred from applying for a job because she is white. The job with Citizenship and Immigration Canada was only open to aboriginal Canadians. The Harper government says it supports affirmative action but not blocking people from applying for jobs based on their ethnic background.

"While we support diversity in the public service, we want to ensure that no Canadian is barred from opportunities in the public service based on race or ethnicity," Day said in a statement.

“They don't understand why having a representative public service is important,” said Ignatieff spokesman Michael O’Shaugnessy. “But most important, they are trying to change the channel. They are throwing some red meat at their most right-wing supporters.”

The NDP’s Pat Martin blasted the move as a sop to “the fundamentalist, neo-conservative, right wing.” Once informed there are jobs that are only offered to certain races, Martin said that was wrong but later changed his mind again.

“Sometimes the pendulum has to swing too far in the other direction,” said Martin, who says aboriginals and visible minorities need extra help in getting jobs with the federal government.

Feds to review race-based hiring policy

OTTAWA - The Harper government will ask for a review of hiring policies for government jobs after a QMI Agency report about race-based hiring policies.

Sara Landriault, a stay-at-home mother trying to re-enter the work force says she was shocked to find out that she was barred from a applying for a job at citizenship and immigration because she was white. The position of administrative assistant was only open to aboriginal applicants.


Immigration Minister Jason Kenney says he was shocked too.
“I was very concerned to read the report of a position only being open to people from an identifiable group,” said Kenney. “All positions should be on the basis of equality of opportunity and merit.”

The problem is Kenney doesn’t have the power to change the rules and neither does the government without altering legislation. Hiring within the federal civil service is handled by bureaucrats; only the legislation and regulations are set by Parliament.

Kenney says he has spoken about this issue with Treasury Board President Stockwell Day, the cabinet minister in charge of the civil service. Minister Day has asked his department to review the rules surrounding affirmative action policies in public service hiring.


Affirmative action is enshrined in Canada’s constitution and legislation dealing with minority hiring practices has been on the books for decades but Kenney says those laws are likely being misinterpreted.
“I’m pretty sure the parliamentarians that included affirmative action in the Charter meant encouraging people to apply,” said Kenney, “giving them equality of opportunity, not restricting people based on race or ethnicity.”
 
“All positions should be on the basis of equality of opportunity and merit.”
