这是我们装之前做的调查,不仅是装空调,builder始终会想办法推卸责任的,但只要我们知道属于自己的权利,他们就没法糊弄了。

(Something you should know and something builder try to hide from you)
This is a very common problem with people buying new homes and at some point we need to get the proper information out to the people so that they can exercise their right to free choice:
Here are a few obvious points should bring attention to every family in this Air Conditioner group:
(1)The parts warranty is held with the Manufacturer of the furnace (not the builder or HVAC supplier), so please register your new furnace with the manufacturer as soon as you take occupancy (the card will be with the furnace literature by the furnace and nobody will tell you this). This product registration can sometimes double the part warranty of a product. The builder, and his agents (the HVAC installer) are obligated to maintain their terms and conditions as set out in the
“Tarion Warranty” here are the exclusion in labour warranty (reasons why they will not honour the labour warranty):
Exclusions (things that will void your warranty)
(2) A warranty under subsection (1) does not apply in respect of,
(a) defects in materials, design and work supplied by the owner;
(b) secondary damage caused by defects, such as property damage and personal injury;

(c) normal wear and tear;
(d) normal shrinkage of materials caused by drying after construction;
(e) damage caused by dampness or condensation due to failure by the owner to maintain
adequate ventilation;
(f) damage resulting from improper maintenance;
(g) alterations, deletions or additions made by the owner;
(h) subsidence of the land around the building or along utility lines, other than subsidence
beneath the footings of the building;
(i) damage resulting from an act of God;
(j) damage caused by insects and rodents, except where construction is in contravention
of the Ontario Building Code;
(k) damage caused by municipal services or other utilities;
(l) surface defects in work and materials specified and accepted in writing by the owner at
the date of possession. R.
So…you can see that in 2(a) builder will have to prove that there is a defect in the work provided by the owner to void the labour warranty of the furnace. If builder can not prove this then there is still labour warranty on the furnace.
Remember… the parts warranty is held with the manufacturer not the builder. The Air Conditioner company providing A/C and installation to families, can get the same parts and fix the furnace under warranty (as well as many other HVAC contractors in this city). Most would like the opportunity to get the maintenance on the furnace in return for the labor compensation for the part change. The manufacturer usually gives the dealer money for changing the defective part if he is a licensed dealer.
Remember…2(b)…builder can also void your labour warranty for a lack of proper maintenance on the furnace as well.
In summary, the air conditioner is an up sell for the builder and they may enjoy a healthy margin on the A/C upgrade. It may be in their best interest to imply to you that your warranty is void, rather than explain to each family “your rights” as a consumer and buy with an “informed” decision.
