“except when in the act of overtaking and passing.”

It's not like they're saying you HAVE to have your high beams on while you pass another vehicle, only that you're allowed to if you need them. A passing driver has the right to see ahead... You would only have your high beams on when you are in the act of overtaking and passing, not behind them (i.e. you're already in the lane next to them. They can't see you in their rear view mirror. The high beams will only be in the lead car's side mirror, which isn't a big deal for the few seconds you will be in that spot.)

我的理解是，in the act of overtaking是“在超车的过程当中”，而不是“跟在后面”（following)"要超车“（going to overtake)。"in the act of"的意思是”in the process of","at the time that","on the point of","during the time that"。 例句：
catch someone in the act (of doing something)
to discover someone doing a [bad] deed at the very moment when the deed is being done. I caught her in the act of stealing the coat.He was caught in the act of taking money from the cash box. （ http://idioms.thefreedictionary.com/catch in the act ）

所以，交通法的这个条款帮不了你。

从你第一个帖子描述的的情况看，警察给你罚单，我觉得是正确的，并没有冤枉你。
当然，如果纯从打赢交通告票角度来看，就是另一回事了。
