3. Depends how much damage you did to me because of mechanic lien attached to my property, I will sue you either in small claim court or super court for over $25,000. You may lose everything you earned.

I already took over $10,000 damage due to your bad work and don't want to take another hit.

I am a chinese and don't want to push you into the corner, however I will do them if you don't remove the mechanic lien from my property immediately.

我第一次去你家,你就透露过你只能贷很少的钱,并把有名的很nice的BMO华人房贷经纪骂一顿,说她不愿贷给你钱。您应该不是第一次干欠钱不给这事儿了,所以你的credit很低。是吧?

本来我作为被控诉者应该少说,不管怎么,多说都只会是越描越黑,但看这个本来还算有意义的帖子演变成了口水贴,没意思了,我只好出来说几句我的一面之词,尽量不说主观结论和看法,算是回答您和之前其他ID的一些疑问。

楼主家的木地板7月初到货,第二天我去刷漆时,开箱随机抽出几条检查,每条宽窄都不一样(不是长短),而且有的相差很大,有1、2个毫米,我告诉楼主及夫人:这是我见过最差的地板,铺上去会有很多缝隙。这样的情况在好牌子的地板里没有,比如mecier,marige等,在homedepot卖的$3-$4的地板里有这样的情况,不过比例很低,一箱大概1,2条而已。而这批地板里大概30%是这情况。

当时楼主对此也没有异议,也比较懊恼,只是说自己不懂,是sales强烈推荐的,而且便宜,$3多一平方英尺,要卖房就没必要买太好的等等。如果退货,要被收20%左右的费用。这之后到7月底铺木地板之前,我又说过多次。楼主后来也没否认我之前告之过此事,但他理解为“你很狡猾,事先就给我打预防针”。

楼主提到自己买的地板是kempas,只要google “kempas hardwood”,搜索出的第一条结果是就可以看到kempas这种马来西亚木头的很多缺点,最大的就是很容易膨胀和收缩(instable,easy to shrink or swell),并且容易开裂( tendency to split and crack ,and flake off)。这就是为什么这批地板大量的不等宽。https://www.google.com/search?hl=zh-...w=1120&bih=588

楼上楼主几次说过在做他家工程的同时,我还有几个其他的工程,因此此工程是在“rush”的状态下完成的,这个我非常不同意。楼主家地板600多sqft,我们两个人干了4天半,平均每天100多sqft,平均每人每天几十平方尺,是我做过最慢的一个木地板,没有之一。楼主可能不清楚正常的是什么速度,但请人做过木地板的朋友应该了解。因为木头越差,越难铺,就越慢。楼主提到我同时还有其他几个工程,但并没有影响楼主家的进度,我们从周日干到周四连续5天,只有其中一天去的晚些。

做完第2天,楼主对一些缝隙不满意,请朋友来检查,他是ottawa一个大builder的木地板和瓷砖的总承包公司的老板,是楼主家的朋友,第二天楼主说,他说你“做的不错,只是有一条木头有crack,需要fix”,这条crack是在木料的后端,并不是我们工具能接触的前端。之后的几天,工程是这样进行的:我每钉完一条,楼主拿抹布擦一条检查。这也是为什么600多平方尺铺了四天半的原因之一。

楼主称“造成了$9000多的damage”,我不了解是怎么计算的,就算全部损坏,无一条幸免,楼主家面积是600多sqft,材料$3多,一共$2000多,人工费我只收了$1000多。
。当时做完最后一天的晚上,我和楼主丈量好面积,计算出总价,楼主称第二天取钱付款。第二天早9点就打电话“通知”我,不能付款,已找人做了评估,要fix后再付款,所有的cost都将由我承担,总共“约10几piece,每条$40”,我电话里对此做法有疑议,楼主说“就是$1000修一条,也得你出钱”。之后楼主就没了消息。直到现在发这个帖子,由几百元变成了$9000的损失。

以上是“地板门”的一些经过,这事儿目前也算告一段落,我和楼主前2天的通话也很平和,楼主表示希望我能从此事吸取教训,今后好好服务于社区,我也提出愿意给一些deduct,楼主也大度的说算了。楼上发帖的朋友们,是客户是朋友是同行或者是素不相识的,是支持的是反对的,也都请听何夫人的劝告吧,请不要人身攻击。算了吧

I am not the contractor and not qualify to comment his work, the only way is to bring the third party for the estimate of repairing the hardwood floor. However, the fee is around $9000.

The first step which I did is to ask him repair, but he told me it neccessary to remove 50 pieces to fix one piece of damaged hardwood. I couldn't accept this idea.
So I told him that I will hire other contractors to fix the damaged hardwood floor and the repairing fee will be deducted from his payment and he agreed it over th phone.

The second step is to bring one well known local company for the estimate of repairing hardwood, they took the pcitures of various damaged hardwood pieces and told me the fees. Now it's my decision
to fix it or not.

I understand it not easier for him to make money, it's the reason why I took the loss ($9,000) in the first place. But what he did is to put mechanic lien to my property without noticing me first. I wouldn't know it if my bank officer hadn't been told the mechanic lien on this Saturday afternoon.

The I tried to email and call him for asking to remove the mechanic lien immediately before I take the legal action next Monday.

If you are his friend, please let him know the consequence of the legal action.

As I know, he has young kid.

我觉得你有点较劲了。挪掉50块就修一块,有点太执拗了。求完美的人很多,特别是自己花了钱的,可是不可预计的事情总有发生的,没必要太计较了。不是太大的影响结构的事情,能修就修,修不了就算了。我们家大大小小工程请过不少contractors,谁也不是把活儿做得让人100%满意的。drywall给打错洞的,留在livingroom里难看的;hardwood floor把明显破损的木头给装最表面的。。。能稍微遮掩过去的,以后再慢慢解决就行了。

Anyway, I called and emailed him on the same day for getting the settle on this case. As you see, there is no feedback from him until now. As soon as I make the claims in three different places, there is no return for me but let the court or CRA rule who is right or not.

所以我在这里劝一下LZ,你这种架势搞不好得不偿失,人家律师也会考虑委托人会不会赖账,要是败诉了会不会被LZ发帖子,这当然是笑话。只是希望LZ别做无赖,丢国人的脸。

For what you just said, Liu Yong could report it to the police as you are threatening the safety of his family, especially to the minor. The mechanic lien is set up by his lawyer, so you don't need to worry about whether he knows the legal consequences or not, on the flipside, you may get yourself a lawyer to settle this dispute. By posting on CFC is not a proper way of resolving issues, I don't know your back ground but what you did is very immature and put your blackmailing comments in writing (in poor English) is really not a wise move on your part.
