撞车后警察给我一张罚单

事情的经过是这样：我们在小区里逛完yard sale,打灯发动汽车出来、就与另一车的车头相撞，我们都是同一方向，一个是左边车头变形，一个是右边车头变形，对方是白人，警察来了只给我一张罚单，罚款理由是：start from stopprd or parked position not in safety.但是实际上对方也有责任，她一边吃苹果，一边开车，并且她承认停在我们后面的车挡了我的车，还有就是她的车速太高，我质问警察，警察无话回答，警察只强调她的路权。现在的问题是想请教前辈，对这张告票，我们应该选择上庭还是选择仲裁?着急！大家有什么好建议说说看，先谢了！

What she did is irrelevent in your case since she's not being charged. She had the right of way, you didn't, theoretically the police was right.

However you should always fight any traffic ticket if the court location is not too inconvenient for you. What can you lose if you fight? Nothing except time, but you may have a lot to gain, i.e. complete drop of penalty points, drop in fine, etc.

You could argue that if she had stayed with her husband at home, you would not have had the accident, but it is nonsence.

Unfortunately, you cannot 估计. On the road, nothing is 正常 or 不正常.

Some smart people have more accident record than idiots. Because they drive based on 估计. Most time their 估计 work. But some times, other people do not follow smart people's 估计. So accidents happen.

Follow the rule not 估计.

你有什么理由"质问"警察? 自己的错, 人没有出事, 就是万幸. 不要找借口, 这对你没有什么好处. 借口永远都是借口, 因为它不是理由.

不明白为什么有人鼓励他上法庭, 这完全错误. 50% 不就拼警察不来吗? 明明是自己的错, 为什么还要赖?

比如说, fine 是 $100 块. 给你 waive 又怎么样? 你就心安理得. 举两个例子:

1. 你买个电脑, 本来是 1,000 的, 人家算错, 收了你 900. 你心里暗自高兴, 交了钱赶快走.

2. 你用无论是什么办法, 骗了别人100块.

上法庭免了100块罚金, 你的道德比例子1的人差, 因为你是自己的过错, 还去狡辩. 可能会比第2个例子的强一点而已.


人还是应该做到在第1个例子, 主动把100块补上. 做人不能没有原则. 贪小便宜的人, 永远成不了什么样子, 还往往最后吃大亏.

你上庭也赢不了。因为明摆着是你的错，还造成了经济损失。一般来说，如果没发生事故，只是警察给你罚单，法官有可能给你减免罚款，可是你的情况也太说不过去了。
