You are funny, so ignorant but funny. You are confusing 2 events here: conflict between 2 parties involved in an accident (which normally results in small claims court) and conflict between a party and police (which normally results in criminal court).

The question the initial poster asked was: "Should I fight for this traffic ticket?", and that's what we've been discussing here. Everyone knows that a traffic ticket not only demands a fine, but also some infraction points. Those points are what insurance companies use to increase your premium. For the past few years, the increase has been substantial, that's how the insurance companies makde record-breaking profits!

To avoid sky-rocketing premium hike, anyone, I mean sane people, should fight for the traffic ticket for as long as it's humanly possible. In many cases, the infraction points are dropped completely, fine could be reduced or even a complete aquittal. I fought my traffic tickets twice, and had won both times.

So before you jump out and yelling bloody murder, why don't you walk a mile in someone else's shoes for a change?

这个社会是怎么搞得?怪不得时不时的发生大大小小的刑事案件。中国人之间的案件也越来越多。真是没办法。

有的人对自己的名声看的重些.出点儿事儿,找律师上法庭尽快摆平.
 
Let me put it in a common person's way: insurance premium is a substantial cost to me, perhaps also to the initial poster and many other families. If there is any legal way to avoid any premium increase, I'd use it.

You can't lose anything, but even there is a slight chance of winning, it's then worth trying.

There is almost always some kind of judgement call involved.

To give you a true example that I had witnessed in traffic court: a man was issued a ticket for not wearing his seatbelt. He went to court and explained to the judge that the reason he didn't wear the seatbeat was that he had a sudden stomach cramp and that he had to unbuckle in order to search for Pepto-Bismol in the glove compartment. The judge then ordered the charge to be dropped.

Following your reasoning: he did violate the law, no question there, since he wasn't wearing a seatbelt, and according to you, he should be punished. But the judge saw a valid reason, so the police's judgement to issue a ticket was overturned.

While this example seems to be pretty straight-forward, there are more complexe cases, so only those who's been given the power of judgement (i.e. judges) can decide right or wrong.

We have a common agreement on the system that it shall punish the ones who did bad things and protect the ones who did good things. If you were treated unfairly, you are definitely encouraged to defend yourself. On the other hand, you must also understand you shall be responsible and deserve punishment for things you did that were not right.

In this guy's (louzhu) case, the fact he told us apparently indicated that it was totally his fault for the accident. In addition to the responsibility for the accident, he also received a ticket from the police. I didn't see anything wrong with what the police did. The guy (louzhu) absolutely started the car from parked position not in safety. That is the fact and the police issued the ticket merely based on this fact. What are you going to do in the court with this fact? You deny, no ways. Are you recommend him go to court just take the advantage if the police does not present? You are abusing the system becasue you know the fact is the fact. It doesn't change no matter if the police comes or not.

In your cases, what kinds of tickets did you fight for? Speeding, not stop at the line, or parking tickets? If you were treated unfairly, you were right to defend. But if you did violate the rule, you shall be prosecuted. If you don't mind, you are more than welcome to share the details.

Don't be jealous the money insurance companies make. They are not non-profit companies. If accidents decrease, so will the insurance rate. We need more people to drive safely - not only for saving money but also for saving our lives. People shall learn from the tickets. Careless and aggressive driving is just one step away from accident.

Nothing is funny when talking about driving and accident.


 
Your argument is seemly too thin to win the case.If you can't afford complete lose or want mitigate it, why don't you have a try? Don't know how someone came up with "abuse".

It also will lead to increase insurance rate if more accidents and more people died in the accidents.

This regulation (wearing seat belt while driving) is helping you to protect yourself. Why he has to violate? He may waive the fine as a short-term "benefit", but he could lose his lfe in long term if keep driving this way.

then why not drive cautiously and safely? Sure it is a better way for saving money. It also helps all of us - the less accidents, the lower insurance rate in general.

I cennot agree with you anymore, Some people are just insane.Don't waste your time to argue with them. They are nuts and arrogant.Don't expect to convince them coz they are just born to argue.You expect them to behave well,NO WAY! Let them go. They will learn more serious lesson if people encourage their behaviour like that in some way!

Just because "louzhu" is at faut, doesn't mean that he/she should not fight. "Right to court" is one of the fundermental human rights. Louzhu has definitely lost the "right of way". I would suggest that he/she do not lose the right to court as well.

It is meanningless to elevate this issue to moral perspective. It is just an accident. Nobody wanted it to happen. Since it's already happened, the right attitude is : Play by Rules.

这个罚单应该是$110, 外加3个点。楼主因无理“质问警察”, 可能会罚多点。
上庭认个罪, 同时编个堂皇理由,减$20到30是可能的。 但要花半天时间,还要向法官赔笑脸,其实不值。
如果没上过法庭, 不妨去见识见识。

保险公司会知道或已经知道了。 来年保险肯定会涨。这与上不上法庭关系已经不大。

没必要道德审判。 这又不是欺负孤儿寡母。

kill himself, 你说得太对了,他是死于accident,原因是被安全带勒晕了

举的例子是偶然的事故,不用延伸到keep driving this way.

同意楼上上庭的说法,
孤星夜雨,我不知道你是不是在保险这个行业里的,如果保险业以亏损为由涨大家的保险,现在盈利(而且是大幅盈利),当然应该降保险.
 
You just don't get it, do you? The point is: it's not up to you or me to decide. The judge made a decision, that's the end of it.

过客 said it all, "right to court" is one of the fundamental rights that everyone in this country has.

Now just a side note: I believe that getting a ticket is already a good lesson to most people. It worked for me. ;)
