Nonsense. It is paid by the Government to people who buy a property for the first time in their life, and the house must be brand new. Since the qualification comes the buyer, why the builder claims it? This term must be removed, otherwise you should give up the deal.

The builder claims it is a "standard clause" in a contract for newly built homes (among the other builders). We showed them the CRA documents, and the "standard clause" is what their respond. I wonder if all of you who have bought a newly built house have such clause in your contracts...
If the builder substract the number of the rebate from the final price, that would be fine. However, in order to know if it is true, you'd better don't tell the builder anything about yourself at the beginning. Negotiate with the builder to get the best sale price. Only when you get written confirmation for the sale price, you tell the builder to substract the rebate number. Otherwise you may get a "空头支票" 或 "画饼充饥".
The buyer will be asked to declare that he/she is eligible for the rebate before closing and consents to credit the rebate to the builder, otherwise the buyer has to pay back the amount of rebate to the builder.
You may find information about new home GST rebate from CRA website under home owner. Normally the new house is priced with net GST, i.e. the actual price plus 6% GST minus the amount from GST rebate. The builder assumes that the buyer qualifies for new house GST rebate and the buyer will consent the claim of new house GST rebate to the builder. The buyer will sign a declaration for your qualification with your lawyer and the rebate form before closing. However, if the buyer is not eligible for rebate, the buyer will be asked to pay the amount of rebate to the builder.This is a normal practice. Of course, the buyer may want to pay full GST of the purchase and claim the rebate directly from CRA. Surely the price the buyer to pay the builder will include full GST, not the same price with net GST. Whatever the buyer chooses, s/he will pay the same amount for the new house.
It is really confusing, but will share my experience, not sure whether or not it will help.
We signed the purchasing contract in May 2006, the house price $250K included GST. In July, the GST was cut from 7% to 6%, we went back to the Builder and got 1% of the house price $2500 deducted from the total price. So my house is actually $247.5K. Many people didn't aware of how the GST would affact their prices, so few peole went back to the builder for it. We were lucky to get that becasue we went immediately after the GST cut. Soon after that, the builder put more standard features to optional, which means they raised the price in other ways.
