查了一下TARION的关于delayed closing/occupancy claim form and homeowner guide,赔偿的最高限是7500。
在我以前的购房合同中,找到这样的条款:(不是楼主的建筑商,那个没找到。但估计都差不多。这个建筑商的口碑比他们还好点)
Termination of purchase agreement:
The vendor and the purchaser may terminate the purchase agreement by mutual written consent, such written consent to be given at the time of the termination.
Nothing in this addendum derogates from any right of termination
that either the purchaser or the vendor may have at law or in equity on the basis of, for example, frustruction of contract or fundamental breach of contract.(这就是我所理解的霸王条款,如果双方在建房过程中起了争执,他们可以说好吧,我不卖你行了吧)
如果要是TERMINATION,那么是
If the purchase agreement is terminated (other than as a result of breach of contract by the purchaser), (这个也是一个霸王条款。我如果毁约了你想解约,行,我就退你押金。如果是你的责任导致的解约,那么对不起押金还不见得退给你了)the vendor shall return all monies paid by the purchaser including deposits and monies for upgrades and extras, within 10 days of such termination, with interest from the date each amount was paid to the Vendor to the date of return to the purchaser. Thepurchaser can not be compelled by the vendor to execute a relese of the Vendor and/or a termination agreement as a prerequisite to obtaining the return of monies payable as a result of termination of the purchase agreement under this paragraph.
按照这个规定说如果TERMINATION,那么卖方就是退还押金和利息,这个利息的计算按照现在的利率环境基本可以忽略不计了。
同时,这个条款还有说明:
" if either party initiates legal proceedings to contest termination of the purchase agreement or the return of monies paid by the purchaser, and obtain a legal determination, such amounts and interests shall be payable as determined in those proceedings"
这个和我原来的理解是一样的,如果你开始法律诉讼上庭的话,那么你的定金在短期内拿不回来。那些钱要被压很久,直到官司最终打下来。
根据这些条款,我个人觉得如果楼主只是想要回押金,取消这个购房合同,完全可以商量做到的。你不需要接受一万的赔偿住进这个不喜欢的房子也不需要非要等不信任的建筑商再给你建一个房子。但是对于赔偿的数额,条款里面没有说。没有客观的标准。
客观来说,赔偿数额想到多少都是你的权利,要多少可能都不能弥补你精神体力进来遭受的周折。但根据TARION DELAY可能赔偿的最高限也算是一个参考依据吧。根据这个依据我觉得双方可以坐下来谈,通过不上法庭的方式心平气和的解决问题。如果你能很快拿到退还的押金,好在从两三个月前买房子到现在,房屋价格还没有涨那么多,你还有时间再找其他建筑商买一个更好的房子。这一页就翻过去了。
我觉得现在我们大家就是去帮你给他们施加些压力,促进商谈的进程,制造一些气氛和声势,帮你拿到最好的结果。但双方都有底线,你的底线你要想好。如果达不到你打算怎么办。同时如果双方差距太大,现在又已经到了CLOSING的时间,对方也有可能采取强硬措施的。
你可以上庭,上庭象前面很多人分析过的,上庭是一个耗时耗力耗钱的解决方案,值得不值得。你要参考利弊以后决定。而且如果要上庭,你交的那些钱短期内是不可能拿回来的,他们一定会想尽办法能拖多久就拖多久的,利息基本就没有什么的。打持久战对你不利。你赶紧再问问律师,考虑各种方法的可行性,最终看哪种方法对你是最有利的。
