这种情况,首先找保险公司,申明你没有责任,你的保险公司一般会找对方的保险公司协商。保险公司之间的协商一般情况下还是比较公平的,但这种小case他们是否愿意花时间去沟通,就取决于你的保险公司了。如果你的保险公司不作为,首先你可以不服警察的结论,上庭申诉。如果玩阳谋,告诉保险公司,你感觉不好,需看医生,找交通律师,索赔200万,你的保险立即就会重视起来。

魁北克这边的警察都这样,只记录当时的情况,不做对与错的判断,保险公司根据report分析谁对谁错。
 
Even though you are an excellent driver doesn't mean you are accident free. 50 % of the time that is deal to other reckless drivers.

LZ is unlucky. You are not caucasian, and probably is a male. The other driver is a caucasian female and she was crying. When the policeman asked you to leave, you should expect that to happen. This is not our country!

There is a highway act, when you change lane, you have to signal, therefore policeman can give you a ticket - dangerous driving, reason, change lane without signalling. Three demerit points. Unfortunately I found many drivers change lane without signalling. If that caucasian female has signalled before she changed lane, you probably (due to courtesy) will slow down a little bit, unfortunately, that probably WAS NOT the case.

I have the following experience. I was driving close to 130 on 401 Sunday night 9:00 pm. eleven years ago, on the leftmost lane (back to Ottawa), a car at my back wanted me to drive faster and kept on pushing highlight. I ignored that driver, suddenly, I noticed he pulled to the right and accelerate, my basic instinct told me, ..., all of a sudden that guy overtook me and brake, the moment he passed my car, I slowed down my car immediately hence NO accident, there are a lot of crazy drivers and we have to always be careful, only if you are pretty sure you have witness (other car drivers) willing to stay behind and be your witness, if not, if you rear ended any car, to the police, and insurance company (like the incident I mentioned that I have avoided not to have an accident), will think it is your fault!.

The above is just my obsertion and opinion. If you rent your car and Lost and Damage is covered by your credit card, then your own car insurance will not be affected, only if you use your own car insurance to cover your car rental insurance, then that is another story. Maybe LZ in future should think about buy car rental company Lost and Damage Waiver insurance if your DRIVE in Quebec. At least you have peace of mind.

As for appealing etc etc, I doubt you can win (since you don't have witness) and you and the other have conflicting stories.

That guy was behind my car while I was driving close to 130, he pushed high-beam light wanting me to give way that he can drive 140 +, since I ignored him, he pulled to the right and acclerate (you can feel his anger by the way he accelerated his car hence I was alerted).
On highway, there are crazy drivers who drive over 130 (this guarantees a speeding ticket if stopped by police), and tail-gating your car. If you drive say 120, those people usually will flash high beam asking you to move to right lane and let them go (i.e. although you are already 20 km over speed limit, they are not satisfied), if you ignore them, and if you are on the leftmost (fastest lane) lane, those crazy drivers have to move their cars one lane to the right, overtaking you and pass (that is OK), but some, will crazy thing, either to scare you, or they want an accident, the moment their car is in front of yours, they step on the brake, and if your car rear ended their car, sorry, your fault, you have to find witness, but on highway when everybody is driving over 100, who will stop (dangerous) and be your witness, when police comes, you will be ticketed - follow too closely (dangerous, three demerit points), and probably others.

I have another similar incident back in 1993 when I was driving on DVP to downtown Toronto, similar scenario, and I was able to avoid an accident. Hence my advice is, if you are not an aggressive driver, try not to drive on the fastest lane, rightmost is relatively more safe and those drivers are usually defensive drivers.

By the way, even in city, there are many drivers who don't have patience, they like to hit car horn just because driver in front is a little bit slow to start... worse is that there are kids inside the car and the driver swearing, flip the bird to the other driver. That bad attitude just pass on to their kids.

路上的恶鬼甚多,还是不要拿自己的命和家人的命来斗气。

第一,如果在最左边道,见别人追你甚急能早让就赶快让,不要等到别人顶你才让(或者干脆不让);
第二,如果不是长途开快车,超车后主动让道给别人;
第三,别人开快车给你开路(因为警察很可能先抓你给让开的车)。

Police arrest man, blame road rage for deadly highway accident

A man faces charges after what police describe as an incident of road rage that killed one man and closed a section of Canada's busiest highway on Tuesday morning.

A 55-year-old driver was thrown from his black SUV when it struck the centre median of Highway 401, according to police. He had swerved to avoid a red car in front that had unexpectedly thrown on the brakes.

Police said the two vehicles had been passing each other aggressively before the red car, believed to be a Pontiac Grand Am or Grand Prix, made a final pass and slammed on its brakes.

"Given the pattern of behaviour [reported by witnesses], this was not inadvertent," said Ontario Provincial Police Sgt. Cam Woolley.

The SUV "barrel rolled" upon contact with the median, sending the driver flying from the vehicle. He was pronounced dead at the scene, Woolley said. The driver of the Pontiac did not stop, according to witnesses.

Before the accident, the two vehicles were seen speeding on the James Snow Parkway in the Milton area before joining the Toronto-bound lanes of Highway 401, police said.

In Quebec, if you drive 20 km below speed limit, that is dangerous driving!

I read an article (Wheels.ca), a driver he and other drivers were driving 130 plus, and he was the last car, and was stopped by police. He asked the police why not stop the first car. The police said, if I stop the first car, that is dangerous since that may cause chain reaction, cars behind probably will rear end cars in front. That makes sense. Hence, don't think you are the last car then you are safe (not stop by police for speeding on highway). Maybe in the middle pack is safe.

Those people who ignore speed limit should drive in Germany.

There is no speed limit there. And Germans are proud of themselves that they build highways that can withstand such high speed.



In New Brunswick, speed limit is 110 km per hour....



Also, it seems that Americans like speeding, no tolerance to those who respect speed limit. Canada is a much safer place than USA.

I agree that is "常识", unfortunately what percentage of highway drivers has this "常识" ? Policemen are already very linient, allowing 20 km above speed limit.
 
如果发生事故了,还要争你对我错,可能就有点晚了。

安全行驶,礼让是必须的。他开的快是事实,你一直占着左道而不让人不仅仅是违规,而且是很容易让人上火的。因为这个出现争执甚至导致事故实在是不值得。

出了车祸就没小事!
