Meng Wanzhou has filed a civil claim against members of the Canada Border Services Agency (CBSA), the RCMP and the federal government, alleging "serious breaches of her constitutional rights" when she was detained, searched and interrogated at Vancouver International Airport in December.

In the claim, filed Friday in B.C. Supreme Court, the embattled Huawei CFO says she is seeking damages for "misfeasance in public office and false imprisonment." It says Meng was held for three hours without explanation and without access to a lawyer before an RCMP constable told her why she was arrested.

It alleges that Meng has suffered "mental distress, anxiety, and loss of liberty" as a direct result of her detention at the airport.

Meng, who is the daughter of Huawei's founder, was arrested on Dec. 1, 2018, while in transit to Mexico and South America.

She was arrested on suspicion of fraud involving violations of U.S. sanctions on Iran, and American prosecutors are fighting for her extradition. American prosecutors claim she and other Huawei executives have been avoiding the United States since learning of an investigation into their activities.

Claim alleges arrest intentionally delayed
The claim alleges a "deliberate and pre-meditated effort" by CBSA officers to obtain evidence from Meng, in violation of her rights under the Canadian Charter of Rights and Freedoms.

RCMP Const. Winston Yep, three unnamed Canada Border Services Agency officers, and the Attorney General of Canada are named in the civil suit.

It alleges the officers obtained a warrant ordering Meng's immediate arrest, but intentionally delayed that arrest under the guise of a routine border check in order to extract evidence from her.

"The CBSA Officers detained the Plaintiff for the express purpose of obtaining information which they and the RCMP and/or U.S. D.O.J. did not believe would be obtained if the Plaintiff was immediately arrested," it reads.

The claim describes the scene at the Vancouver airport in early December, when Meng was among the first dozen passengers to exit her flight onto the jetway.

It says CBSA officers were screening passengers "for the sole purpose of detaining the Plaintiff and unlawfully searching and interrogating her before turning her over to the RCMP."

It claims the CBSA officers "knew or were recklessly indifferent to the fact that their detention, search and interrogation of the Plaintiff … was unlawful."

Devices seized
The claim alleges Meng's detention was "unlawful" and "arbitrary," and that she had no freedom of movement after she was apprehended on the jetway.

The claim also alleges CBSA officers unlawfully seized two personal cellphones, an iPad and a personal computer and took them to a private office, then demanded Meng surrender her passwords. It says the officers "unlawfully opened and viewed the contents" of the devices and searched Meng's luggage, in violation of her right to privacy.

Canada 'vicariously liable'
The 13-page document also claims that CBSA officers subjected Meng to unlawful interrogations over a sustained period, adding that Canada is "vicariously liable" because the officers are employed by the federal government.

None of the claims have been proven in court.

The CBSA declined to comment on the claim as it is before the courts. The RCMP did not immediately respond to CBC's request for comment.

Meng has been living under strict bail conditions in her Vancouver home since her release last December. She has hired at least 13 lawyers from six law firms.

On Friday, Canada announced that an extradition hearing for Meng can move forward.

Meng's defence team said in a statement that she maintains she is innocent of any wrongdoing and that the U.S. prosecution and extradition is an abuse of legal process.

TORONTO — An executive of Chinese tech giant Huawei is suing the Canadian government, its border agency and the national police force, saying they detained, searched and interrogated her before telling her she was under arrest.

Lawyers for Meng Wanzhou said Sunday they filed a notice of civil claim in the British Columbia Supreme Court. Canada arrested Meng, the daughter of Huawei’s founder, at the request of the U.S. on Dec. 1 at Vancouver’s airport. She is wanted on fraud charges that she misled banks about the company’s business dealings in Iran.

The suit alleges that instead of immediately arresting her, authorities interrogated Meng “under the guise of a routine customs” examination and used the opportunity to “compel her to provide evidence and information.” The suit alleges Canada Border Service Agency agents seized her electronic devices, obtained passwords and unlawfully viewed the contents and intentionally failed to adviser her of the true reasons for her detention. The suit said only after three hours was she told she was under arrest and had right to counsel.

“This case concerns a deliberate and pre-meditated effort on the part of the defendant officers to obtain evidence and information from the plaintiff in a manner which they knew constituted serious violations of the plaintiff’s rights,” the claim says.

Meng is out on bail and living in Vancouver awaiting extradition proceedings.

On Friday, Canadian Justice Department officials gave the go-ahead for her extradition proceedings to begin. Meng is due in court Wednesday to set a date for the proceedings to start. It could be several months or even years before her case is resolved.

Meng’s arrest set off a diplomatic furor and severely strained Canadian relations with China. Beijing has accused Washington of a politically motivated attempt to hurt the company.

China detained former Canadian diplomat Michael Kovrig and Canadian entrepreneur Michael Spavor on Dec. 10 in an apparent attempt to pressure Canada to release Meng.

A Chinese court also sentenced a Canadian to death in a sudden retrial, overturning a 15-year prison term handed down earlier. Kovrig and Spavor haven’t had access to a lawyer or to their families since being arrested.

Nicholas Dorion, a spokesman for the Canada Border Services Agency, said it’s not a practice of the agency to comment ?on legal matters that are before the courts. A justice department spokesman referred comment to the border agency and a spokesman of the Royal Canadian Mounted Police said they were unlikely to comment Sunday.

Gary Botting, a Vancouver extradition lawyer who is not representing Meng, said Canada’s Border Services Agency tends to overstep.

“They took her under custody without telling her why,” Botting said. “They disguised the real reason why they detained her. Her rights were violated.”

Botting said they had no reason to detain her as she had travelled to Canada many times before. “They are trying to get all this information ahead of time and they know ultimately an arrest was in the works,” he said.

Julian Ku, senior associate dean for academic affairs at Hofstra Law, noted the civil action is separate and apart from Meng’s extradition proceeding. He said the lawsuit will allow her to argue she is being unfairly treated and support her broader public relations claim that the detention is part of a U.S and Canadian political conspiracy against Huawei.

法制国家??开玩笑,也就是小土豆扛着不肯有动作, 否则, 直接在一开始司法部长不同意的话,根本不会动手抓。
到了法庭, 小土豆也有足够的办法让法官放人。

根据代表孟晚舟的律师事务所Gudmundseth Mickelson LLP的消息,他们在3月1日向BC省高级法院提出民事诉讼。

法庭文件的记录显示,孟晚舟指控加拿大边境事务局官员在孟晚舟被捕前对其非法搜身、拘禁、询问、以及搜查证据。

在上个星期五,加拿大政府宣布将会开始对孟晚舟的引渡流程。加拿大方面称,加拿大是法治国家,这一决定是由加拿大司法部做出的,不牵涉党派政治。

中国方面对加拿大开启引渡流程十分不满,并称加拿大与美国合谋骚扰身为华为高管的孟晚舟女士。目前,华为是中国最大的私营公司。

一场华为公司首席财务官孟晚舟律师团与加拿大政府之间就其被捕和引渡的拉据战上演了。据加拿大当地媒体报道,孟晚舟律师团队已经对加拿大政府、加拿大边境服务局和皇家骑警(即联邦警察)提起诉讼,指控他们在未告知她的情况下,就对她进行逮捕、搜查和审讯,这些做法都侵犯了她的宪法权利。

就在两天前加拿大司法部向检察部门签发引渡授权,标志着引渡孟晚舟进入司法程序。加拿大将在3月6日决定对其引渡聆讯作出安排。

两个月前,美国司法部起诉中国电讯巨头华为及孟晚舟,指控其向美国银行隐瞒出售给伊朗的设备,违反美国对伊朗的制裁;并提出窃取商业机密等23项指控。

美国向加拿大提出引渡孟晚舟到美国受审。中国要求释放孟晚舟,并对加拿大施压,质疑其司法独立。

此案件涉及多个国家的利益,其法律程序极其复杂,并可能受到政治因素左右。BBC中文为你梳理关键点,并分析背后的决定因素。

第一阶段:引渡聆讯的司法程序
加拿大司法部3月1日向其首席检察官签发引渡授权进行书(Authority to Proceed),不列颠哥伦比亚省最高法院(British Columbia Supreme Court)将在3月6日确定引渡聆讯的具体安排。

引渡聆讯并非刑事审判,其法律程序是为了确定如果孟晚舟在加拿大审判,其涉嫌的罪行有可能导致一年以上的监禁。根据加拿大《引渡法》和美加引渡协议,引渡人涉嫌的罪行需两国都认定为犯罪行为,才符合引渡条件,即俗称的“双重犯罪”(dual criminality)。

加拿大阿尔伯塔大学法律学院教授哈里顿(Joanna Harrington)对BBC中文说,3月6日还可能确定聆讯的期限、是否有证人出庭等。通常来讲,聆讯阶段需要数天时间,并经历证人出庭、证据呈堂、法官检阅材料及作出决定等程序。整个过程可能历时数月。

哈里顿说,引渡聆讯主要考虑是否有充分证据证明案件符合进入审判程序的要求。呈交给法庭的证据仅来自一方,即由美国在提出引渡时通过加拿大提供的案件记录(record of case)。记录不需要完整,充分即可。

哈里顿说,法官在聆讯程序中的角色“非常有限”。“加拿大的司法系统非常强大,法官独立且公正。《引渡法》明确了法官的职责。”

加拿大和美国之间存在长期的引渡关系。鉴于两国地理位置接近,加拿大的许多引渡请求都来自美国。两个国家具有共同的法律文化、相似的法律制度,因此存在高度信任。哈里顿分析,根据过去的案例来看,可以预测加拿大将批准引渡请求。

第二阶段:加拿大司法部长决定是否移交

一旦法官认定,如果孟晚舟在加拿大审判,其涉嫌罪行可导致一年以上的监禁,将发布拘押令(order for committal)。之后案件转交给司法部长,由其决定是否最终引渡。如果成功引渡, 孟晚舟将在美国受审。哈里顿说,最关键的决定在于加拿大的司法部长。不同于此前的司法程序,加拿大司法部长在审理引渡时会有“更广泛的考虑”。

司法部长将参考美加引渡条约的条款和加拿大《引渡法》的立法要求,来确定引渡后是否会对引渡人产生不公正的处理,或案件是否将会因外界因素承受压力。其还会考虑保障公平审判权利的加拿大《权利与自由宪章》(Charter of Rights and Freedoms),以最终确定是否执行引渡。

在聆讯的司法程序和司法部长审理阶段,孟晚舟均有机会上诉。哈里顿说,在引渡之前穷尽各种法庭程序并不罕见,而上诉亦将拉长整个审理时间。

中国一直要求加拿大释放孟晚舟。3月2日,在加拿大司法部签发聆讯授权之后,中国驻加拿大使馆发言人发表讲话,对签发行为表示“强烈不满和坚决反对”,认为事件呈现出“明显的政治干预”。

发言人说,“孟晚舟案不是一起简单的司法案件,而是对一家中国高科技企业的政治迫害。”

哈里顿认为,孟晚舟的律师的确可能用政治迫害的观点反驳指控。但只有在加拿大司法部长的审理阶段才有可能发挥作用。而政治因素也可能令案件在此阶段承受压力。

两案交错,美加合力决定华为命运
引渡程序进行的同时,另一单涉及华为的案件刚告一段落。两件案件的时空交织,令华为备受关注。

美国政府控告华为子公司窃取美国电信公司T-Mobile商业机密。起诉书提及,华为在2012年至2014年期间窃取T-Mobile用于测试智能手机耐久性的技术。

2月28日,该案在美国西雅图西区法院进行答辩程序。华为否认全部控罪。法院判定,案件将在明年3月2日正式审讯。

哈里顿认为该案件不会影响美国向加拿大提出的引渡孟晚舟的决定,除非美国决定撤销对孟晚舟的起诉。她说,无法预料美国将在未来做出什么决定,也许到案件审讯之时情况有所变化。

美国金理德律师事务所合伙人王昶对BBC中文说,从目前的情况来看,美国撤除引渡要求的几率为零,原因在于“美国保守派中的极右势力在现政府中主导对华政策,其主要干将均对中国采取强硬态度。”

在宣布对华为及孟晚舟的指控时,美国联邦调查局局长克里斯托弗·雷(Christopher Wray)称,华为无视美国法律及国际商业准则。“华为这样的公司对我们的经济和国家安全都构成威胁,”他说。

克里斯托弗·雷是美国新任司法部长巴尔(William Barr)的部下。据王昶观察,巴尔对华态度非常强硬,认为中国对美国的威胁高于直接干涉美国政治和选举的俄罗斯。

他提到近日美国极右势力举行的保守派政治行动大会(Conservative Political Action Conference),认为会上已经达成共识,“淡化或忽视俄罗斯对美国的威胁,强调中国威胁论。”

王昶认为,在这样的基本策略指导下,特朗普政府将继续在美国境内抓捕中国间谍,同时在全世界范围内打压可能对美国国家安全和商业利益造成危害或构成挑战的中国公司。

“现政府在打压像华为这样的公司上不会手软,不会后退”,王昶说。

虽然美国撤销对华为的指控和引渡要求的可能性微乎其微,但王昶认为,“仍有不确定因素可能改变一切”。不确定因素包括美国国内政治和特朗普政府对华政策集团可能发生的突变。

中国方面则质疑加拿大政府宣称的司法独立,称孟晚舟案不是一个司法案件、而是对中国高科技公司的政治迫害,并把最近SNC-兰万灵行贿案引起的加拿大政坛风波作为加拿大政治干预司法的例子。

孟晚舟将在3月6日出庭面对法庭听证。据统计,98%的美国引渡要求都获得了加拿大法庭审理。但是被告有多次上诉机会,审理过程可能会长达数年;而现在孟晚舟一方不等到法庭引渡听证开始就先行上告加拿大执法机构,这显示了孟晚舟方面准备打法律持久战的对策。

孟晚舟已经从6个律师事务所聘用了至少13名律师。
