在众所周知的一次火灾后,众多受害者无家可归,这其中包括我。原来的房子已不可住,可是,原来房屋的二房东不退还以前的房租押金,并且,这押金是2个月的。按法律规定,租房是不用给押金的,最多是收最后一个月的租金。请问大家,如何才能讨回这2个月的房租押金? 衷心感谢楼下能提供帮助的人。
 
凭押金的收据,上面应该写着是押金,所谓押金就是要退的,赖不掉
 
我是freebbs的2房东,他姓名我就不提了。

他住进来之前,我就说得很清楚,要订房,交500押金,退房时候退钱。不交押金就不租。其他住客都这么办的。

他同意了,当时放下200$定金,说过几天搬,搬入之前补齐。

过了几天以后又说不能搬,要过50多天以后再搬。ok,我又同意他50天以后再搬。其中的麻烦,大家可以想像。

50多天后,交钱入住,过了几天,他又说,收押金在这里违法,你违法了,不退押金,我可以告你。 找房客4年了,都是这么操作的,头一次遇到要上法院的。 ok,按他说的办,上法院看看法官怎么说,我就怎么办。

又住了几个月,没有动静,由于accident必须全体搬走,ok, 其他人的押金我都退了。他的没有退,是因为想看看这里到底什么合法什么不合法,法官怎么判, 如果不能收押金,房东利益如何保证?于是我在电话里, 当面,都和他说清楚了,如你所愿,法庭上见。

这又过了1个月,没有人通知我上庭的时间地点,却发现有马甲在这里三番四次的来捣乱,损害个人名誉,昨天我给他打电话也不接,我就让这里CFC的老板Riven删除了这些帖i子,结果还删之不绝,今天又发个这个贴。看来又不得不陪他在这里来玩马甲了。

先说好住,又改成推迟住。 先说好交押金,交了押金又不满意,要上庭,现在又不上庭,上cfc注册马甲背后中伤人。 我说,你能不能做事不要绕弯子,约好干啥就干啥,直接一点,爷们一点。
 
Why would you like to do that if you know that you should return his money back? If you don't like him, the best way is to get rid of him as soon as possible which means give his deposit back to him, and never rent your room to him again, otherwise he may go to the small claim court and you may still need to return the money back as you cannot do the wrong thing just because someone did a wrong thing first.
Good people can live longer :p.

掺和一下。 押金的问题属于楼主年幼无知,但毕竟新来乍到,有情可原。 退押金的问题房主也别斗气啦, 还给人家, 算是高风亮节吧,毕竟大家都人在他乡。

Does a landlord have to pay interest if a rent deposit is collected?
Yes, the landlord must pay the tenant interest on the rent deposit every 12 months. The amount of interest that a landlord must pay is the same as the rent increase guideline that is in effect when the interest payment is due. The guideline is set each year by the Ministry of Municipal Affairs and Housing. Information about this year’s rent increase guideline can be found in the Brochures by Topic section of our website.
Note: Landlords may deduct the amount needed to update the rent deposit (so that it equals the current rent) from the interest that is owed to the tenant. See previous question.
If the landlord does not pay the interest owed to the tenant when it is due, the tenant can:
deduct the interest from a future rent payment, or
file a Tenant Application for a Rebate (Form T1) to the Board.
 
从这个帖子来看,看不出LZ在捣乱或诋毁“return”。因为他/她没指名道姓。只是询问信息。
如果不愿意把问题复杂化,建议“return”退掉押金。与人方便,自己方便。
 
鄙视这些违法收钱还不知羞耻鼓噪的房东。不就看房客不想耗时耗力打官司吗?官司不上身也不代表你的行为不可耻!贪婪的房东总有一天自食其果!
总有那几颗老鼠屎损害房东的声誉。
如果他有固定住所,建议LZ把他送上法庭。

The landlord can ask for a deposit in all provinces and territories, except Quebec. In most jurisdictions, this deposit protects the landlord if the tenant:
  • doesn't pay the rent
  • leaves without notice
  • causes damage
  • doesn't clean up properly when moving out
 
是的,但是很多公寓还是要收押金,有的非要求3个月房租的押金。
