Trump campaign files election lawsuit in Wisconsin​

The Trump campaign filed a long-shot lawsuit in the Wisconsin Supreme Court today, seeking to remove over 221,000 votes from Wisconsin's certified presidential election vote total. The Wisconsin Supreme Court must accept the case in order for it to go forward.

The campaign alleges that the recounts in Dane and Milwaukee counties uncovered "serious legality issues" in the way ballots were cast and counted, specifically in absentee voting in the state.

The case does not make any claims regarding election fraud.

Similar lawsuits to throw out votes in other battleground states have been unsuccessful.

Pennsylvania congressman files longshot petition with Supreme Court seeking to nullify certification​

Pennsylvania Rep. Mike Kelly has filed a longshot petition asking the Supreme Court to nullify the certification of Pennsylvania election results.
Kelly is challenging the Commonwealth’s “no-excuse” absentee ballot scheme that was passed in October 2019.

It is the latest petition from Republicans still seeking to challenge the election and it faces steep odds at the Supreme Court, particularly because the dispute turns on issues of state law. The Pennsylvania Supreme Court dismissed the challenge last weekend holding that Kelly and others failed to file their challenge in a timely manner.

“It is beyond cavil that petitioners failed to act with due diligence” in presenting the case, the court held noting that they filed the suit more than one year after the enactment of the law at issue.

The new emergency petition will be filed with Justice Samuel Alito who has jurisdiction over the Pennsylvania courts. He will likely refer it to the whole court. It has not yet officially been received by the clerk’s office.

Election law expert Rick Hasen of the University of California Irvine notes that Kelly is seeking an order to nullify the effect of the certification of elections but that “it is not clear that this kind of remedy is even available.”

“I do not expect this case to go anywhere at the Supreme Court,” Hasen said in a blog post.

Lawyers for Kelly argue that Pennsylvania’s General Assembly “exceeded its powers by unconstitutionally allowing no-excuse absentee voting, including for federal offices, in the Election.”

They argue that the legislature’s move violated both the Pennsylvania Constitution and the US Constitution. “Because the Pennsylvania Constitution has not been amended,” they argued, “the legislative efforts to authorize no-excuse mail-in voting are fatally defective and inherently unconstitutional.”

After more than 30 defunct lawsuits in 30 days, attempts by President Trump and his backers to overturn the election of Joe Biden as the next president have failed in court — sometimes repeatedly, with judges gutting claims and shutting down all possible legal avenues to interfere with the Electoral College.

The President's effort isn't stopping, with more lawsuits and appeals getting filed almost daily and more than $170 million raised in response to pleas for cash from Trump.

But officials across the country confirmed that the 2020 vote was secure. Biden's victories have already been certified in six of the most closely contested states — Arizona, Georgia, Michigan, Nevada, Pennsylvania and Wisconsin. His wide Electoral College win over Trump is secured, and will be formalized this month.

Judges have rejected Trump's attempts so thoroughly over the past few weeks, they've shut down the cases on nearly every question they're asked.

One federal judge in Pennsylvania, Matthew Brann, wrote he couldn't do what the Trump campaign and Trump's personal lawyer Rudy Giuliani wanted because it would be unconstitutional. A judge in Michigan, Timothy Kenny, explained point by point why witness statements suspecting fraud fell short.

A judge on the Pennsylvania Supreme Court wrote in a concurring opinion last weekend, which denied a Republican attempt to throw out millions of absentee votes in the state, that the court shouldn't "lend legitimacy to such transparent and untimely efforts to subvert the will of Pennsylvania voters."

And yet, Trump's dreams linger in court. Ongoing cases still look to push false narratives of fraud — often built on their disbelief of Biden support in heavily Democratic cities and unhappiness with absentee voting.

Sidney Powell released the Kraken. And it turns out the mythological sea beast can't spell, is terrible at geography and keeps mislabeling plaintiffs in court.

A congressional candidate Powell claimed to represent in one lawsuit said that, in fact, he had nothing to do with Powell or her quixotic effort, which she dubbed “the Kraken,” arguing the election was stolen from President Donald Trump. An expert witness cited in another suit named a nonexistent county in Michigan. A Wisconsin lawsuit sought data on alleged irregularities at a voting center in Detroit, which is in Michigan. And a filing in federal district court signed by Powell misspelled “district” twice in the first few lines.

Federal judges rule against lawsuit to overturn Michigan election results​

A federal court in Michigan threw out the latest lawsuit seeking to overturn election results in the state, this time shutting down efforts led by Sidney Powell, a former Trump advisor who was disavowed by the campaign.

The judges determined that the lawsuit was full of “nothing but speculation and conjecture” and that Powell and her clients’ goal of forcing the state’s electors to vote for Trump even though Joe Biden won the state, was not only impossible since the state has already certified its results, it was also meant to disenfranchise voters.

“They seek relief that is stunning in its scope and breathtaking in its reach” the judges wrote. “Plaintiffs ask this Court to ignore the orderly statutory scheme established to challenge elections and to ignore the will of millions of voters. This, the Court cannot, and will not, do. The People have spoken.”

The court went as far as to argue that the plaintiffs were less interested in actually achieving their relief and more focused on “the impact of their allegations on People’s faith in the democratic process and their trust in our government.”

Led by Powell, plaintiffs in this case relied on recycled allegations, many of which were made by Trump attorney Rudy Giuliani and the witnesses he brought forward to testify in front of the Michigan House Oversight Committee last week. For example, plaintiffs in the case alleged that the ballot tabulating software used in the November election mirrored a coordinated “criminal conspiracy” used to manipulate Venezuelan elections in favor of the late Hugo Chávez.

The Michigan ruling is the latest defeat in a weeks-long effort by the Trump campaign or Trump allies seeking to overturn election results across the country.

To date, the Trump campaign and Trump allies have won one case in Pennsylvania concerning absentee voters and have lost or withdrawn about 40 cases.

Federal judge dismisses latest election challenge in Georgia​

A federal judge in Georgia dismissed two motions on Monday morning brought by attorney Sidney Powell aimed at reversing the election results in that state.
“The plaintiffs do not have standing to bring these claims,” Judge Timothy Batten ruled from the bench immediately following about an hour of arguments.

Judge Batten also dissolved the temporary restraining order that stopped election officials from clearing the latest election data from Dominion voting machines in Cobb, Gwinnett and Cherokee Counties. Election officials in Georgia have said the machines will be needed for early voting that starts in the Senate runoff election in two weeks.

Batten further said that the plaintiffs waited too long to take such action. “This suit could have been brought months ago before the election, at the time the machines were adopted. The relief they seek, this court cannot grant.”

Finally, Batten called the relief Powell was seeking “the most extraordinary relief ever sought in any federal court,” as it pertains to elections. “They want to substitute the judgement of this court for that of two and a half million Georgia voters who voted for Joe Biden. This I am unwilling to do.”
