i had followed these threads from beginning. from what bdw told, only right before closing date, from minto's lawyer's mouth, "sold as is" was given to bdw. nothing stated in the contract.
i'd like to know the both sides of story so i had phoned/emailed to minto office to seek their explanation, their side of story(nicely), but no single word from them at all.

For Minto, it thought the home in question is an inventory home and it is sold as is. Otherwise, it contradicts itself -- Do you see a brand new home to be build is "sold-as-is" from large new home builders like M, U, M or R? In other word, buyers will getting a home without any change option ? inventory home is "sold-as-is" unless the buyer is willing to pay much more to change it (like mimi_ge's said).
Now Minto may realized late that there was a mistake (such as price and area) and offered BDW $10K deduction like other inventory home. For me, it is a clear clause.
